good evening everyone the Durham Public Schools Board of Education work session is now in session at this time we wish to extend a warm welcome to everyone who is joining us this evening the purpose of this meeting is to inform our parents staff and constituents about the work aligned with our mission to embrace educate and Empower every student to innovate serve and lead tonight the administration will will be presenting information to keep you up to dat on the workings of the district the interpreters tonight are Vanessa Peña Ramirez and Marti Ramirez thank you so much for taking the time to join us tonight the next item on our agenda is a moment of silence just wanted to note we've had an incredibly busy last couple of weeks and as we take this moment of silence I'd like to reflect on the amazing work of our administrators our staff and our students for a strong end to the school year this isn't an easy time of year and
we're grateful for all of your hard work for many this hard work culminated in graduation we're so proud of all of our DPS graduates and grateful for all of those that supported them on this path I'd also like to reflect on the incredible investment in our school system made this past week by our Board of County Commission Commissioners were so grateful to them for their partnership and to interim superintendent CAD Moore for her strong leadership during this time um finally also we're celebrating pride month and while there are gains to celebrate this month our lgbtqia plus community members are still experiencing oppression I'd like us also to reflect today on the ways that we can continue to cultivate safe affirming and welcoming spaces here in our school system and in our community I'd also like to acknowledge there's a lot going on I'd also like to acknowledge violence in our community and in our world and with all
of that to reflect on and all of the work we have to do let's take a moment of silence the next item on the agenda is agenda review and approval colleagues I would like to make an amendment to the agenda um item 2A contract with maner construction company for installation of crosswalk and sidewalk addition at Lions Farm Elementary School and move that to um down below 4 a making that 4B for discussion okay so motion to amend the agenda to remove an item from the consent which is the contract with linear construction for installation of crosswalk to section 4 making it did you say 48 4B okay second second okay it's been properly uh moved by board member Lewis

member Byer and seconded by Miss Rogers all in favor I I I all opposed all right um the board um minutes from from May 9th 2024 have been approved um our the next item on our agenda is general public comment I will read um a quick review of the rules before we get started um please state your name if speaking for an organization please state your name and the name of the organization second speakers are asked to present their comments in three minutes when the yellow light comes on you have one minute left to start winding up your remarks when the red light comes on it will beep which indicates that your time is up complaints about name staff students or parents should not be voiced in Open session however we are very interested in hearing your concerns with regard to public education safety of students or to the operation of the school system finally board members will listen
carefully and consider the comments but we do not engage in a discussion with speakers our first Speaker this evening is um Mary Elizabeth heni good evening thank you for making space for public comment my name is Mary Elizabeth are you telling me to stop my name is Mary Elizabeth hansy um I am not going to do a lot of credentialing but the thing I want you to know is that I went to Eno Valley Carrington and Northern and we have decided to keep our kids in DPS with intention even though my husband has commuted to Raleigh for over 20 years sorry Wake County Schools we chose Durham and Durham schools I come to you today to ask that you find a way to have at least one nurse in every single school and that you in addition to that have support for those nurses in the form of um other
medically other nurse attendance um in schools that have more than 600 students in accordance to the National and state guidelines I want to tell tell you a story about my own child and why that this child requires a nurse in the school and why she is therefore not in the dorm Public Schools right now because we had to pull her because she was not safe but I also want to advocate for all of our students who need a nurse in the schools we know that public health outcomes are improved for our marginalized communities for every student that is in the schools when there are nurses there uh for our nurses because they feel unsafe with the delegation that is currently required by the nursing status in Durham and they are leaving schools where they are required to delegate in ways that they feel their license is at risk and our staff members who are asked to make decisions and provide medical
care that is far beyond what they should be doing my child Lucy carries her emergency shop with her everywhere can you show everyone that you have it with you I could tell you all right now what you need to watch for in order to give her this emergency shot and you would be really upset to be given that responsibility is are her eyes glazing over is she becoming pale right now she it cannot be in the dorham public schools because there could be a nurse there on the day she has an emergency or there might not be it depends depends on the day she in fact had a experience in her Elementary School where she was her protocol was not followed the nurse was not present she was then allowed to walk home from school in the heat which is a part of her danger she nearly passed out in the road and I had to give my high schooler instructions over the phone about how to keep her safe until I got there and decided to whether to call an ambulance because there was not a nurse at
Creekside when she was outside in the heat I have a lot of information here about how delegation what nurses should do but the thing that I want to tell you is that they do not need to come out of your budget nurses should not come out of your budget thank you can you leave that if you leave the information with us or if you prefer you can email it to us that's great thank you so much okay um the um next person on our list for public comment is John hajes coupple hi I'm John hajes Coppel I'm sure you're tired of seeing me uh but this is so important uh Durham for DSA uh persists in listening and responding
so that we can all be certain that we can both transform form DSA and fund the elementary schools we promis to the voters we wish that DPS would do the same but instead seems content to pretend that not only will the defunded elementary schools be just fine but so will all the other schools with their growing list of system breakdowns and although we still have not received any written documentation from DPS despite repeated requests we're not asking for new work this is stuff you've already done we at least know enough to be confident that you can have a sparkling downtown DSA and do two more Title One Elementary School Renovations that will otherwise fade into some Far uncertain future why do you care so little not with your words but in your actions for your most vulnerable students let me try something a little different so there can be no

a but if your costs for new DSA come in lower so will cost for transforming current DSA because our costs pivot off your costs in my 40 plus years of professional experience I have never been involved in a project that is so rif with half truths misleading information unsupported assertions and ill-informed speculation it may not be the job of consultants and Architects to care about 10 tens of millions of dollars of desperately needed dollars but it is your job to care it's still not too late even with the money already spent you can choose to benefit more schools and more students which will you choose Thank you thank you that's all I have on my list okay Miss Carson can I also just make a few comments take some per app point a personal
3 this equates like I said earlier to 98% of our Board of education's requests and we acknowledge that this allocation has was curated from a budget that's designed to address the needs of all of our community and the durm county commissioner's action demonstrated that public education in durm is a top priority we know that allocation will increase compensation for classified and certified employees it'll add supplements for hard to staff positions it'll include some Capital out lay funds
for our much needed buildings as well as prek funding all of which we will contingent on the states by annual budget and we'll have an opportunity to review our budget again in the fall and also want to just note that we know staff received emails this uh today about projections pending budget the state's budget for salaries we know there are a lot of questions and we are working to answer those questions so I just want to acknowledge there's a lot of questions out there about what does this mean for me and I want to acknowledge that people have those though County Commissioners have demonstrated that a shared agenda creates Synergy which means that we can produce greater results together and then we can as individual units board our continued advocacy through phone calls board meetings and budgets over many years have led us to this moment and the county has also U indicated they want more collaboration so we look forward to continued meetings with them moving forward this is our charge and our pledge that as we move forward
together we'll continue to strengthen our processes and procedures we have contined to be and will continue to be even more transparent and inclusive honest and accountable for the work that we're doing as a public school system I want to thank interim superintendent catd Moore for her leadership uh our community for their advocacy durm Association of Educators for all of their work and all the other community groups the parents the neighbors who also advocated on our behalf for this budget it's historic it's unprecedented it was bold and it was necessary and I'm grateful for the work we've done together thank you all I could add just one couple couple quick comments to the end of that um I'd like to also express my appreciation to all of the folks who have been a part of this journey over the last few months um this was the the pending budget request was one of the first things that I started looking at and starting to Fig started to figure out okay where do we need to go and I will tell you the the driving priorities
as we developed the initial ask were really how do we continue the work that was started with the incredible vision of this community and the Commissioners to look at what market rate salaries for our classified staff would look like acknowledging the missteps and miscalculations that led us to a crisis in the middle of the school year and what it would take to really build that back um and knowing that our employees had waited for many years before that and we're now putting on hold again based on the decisions that we had to make as a as a school board in a system uh to finish the school year and so that was a a top priority and I think the board echoed that when you expressed your priorities moving forward I think the other piece that is important is um acknowledging that um because of the heavy lift that would take that um even though the past year the year that we're currently in was the year for classified staff and then the next year was supposed to be for certified staff because of that alternating year Cadence that DPS has established that you just
5% um of what was asked for so thank
you to the community to the supporters the stakeholder groups the teachers the parents the AE everyone who was a part of acknowledging these needs and supporting these needs as we brought them forward um and and then the last thing I will say is because remember that at the other side of every single one of these dollars are 30,000 children who will benefit whether it is in their facilities or the staff that they have in their buildings and the quality of that staff um and and and they will benefit from it and then the overall Duram Community will benefit because our public schools are an economic driver and engine in our communities so thank you again thank you all right the next item on our agenda is the consent item take a motion move approval of the consent agenda items that were previously
labeled b c d and e second okay it's been moved by Miss Byer and seconded by Miss Rogers is there any discussion okay all those in favor I all those opposed right passes unanimously um next item on the agenda is under Chief of Staff um we have policy 232 remote participation in board meetings good evening board members superintendent Moore members of the community this is a revision of an existing policy entitled remote participation in board meetings I would direct your attention to board docs which has all of the track changes in it we did I drafted this in response to several issues that we were kind of encountering around virtual meetings as well as some additional Clarity around
having virtual meetings outside of a declared state of emergency as you recall during covid there was a state statute that passed and we just wanted to make sure that it was clear for Durham that this board was authorizing itself to meet virtually in its board policy since the declared state of emergency was rescinded so that's the uh primary edit in there and then with regard to quasi judicial hearings there was an allowance under that state law during a declared state of emergency to allow for those when there was consent and we added a paragraph I believe it's e for the allowance of Quasi judicial hearings to be virtual outside of a declared state of emergency which is where we are currently existing with the consent of all parties so that language is in there and we did um draft that Mr Malone uh then reviewed it provided a few minor tweaks to it and we are presenting it here to the board with a request if you look at the um preces
that the board wave its policy um 2420 on the adoption of policies and wave a second reading so that we can continue to basically have the authority to me have these quasi judicial hearings and virtual meetings as needed starting effective today with the board's adoption it is is not um urgent necessarily right if we could bring it back for a second reading if the board is not comfortable but it would be um advisable to since we have been having these virtual meetings um under that declar state of emergency kind of Continuum that we were operating under to make it proper under board policy happy to take any questions thank you Dr Giovani board members yes M sh is I just had two points of clarification the first one is that when
I just want us to State this out loud when we refer to regularly scheduled board meetings that does not include work sessions those are only our or it does in which section are you uh d three it would be my understanding and my interpretation that that does include work sessions so those are board meeting so you're saying with regard to board members remote participation in the meetings I can clarify that and include to make it clear that but I would I can work sessions are board meetings officient regularly scheduled board meetings okay yeah I think it's just a it's a the difference between the difference between a board meeting and a board work session a board work session is still a board meeting and so I think I think that's where you're we're trying to make sure that
we're explicit so that people who are reading it don't find it narrow yes yeah I I think all right that's that's helpful I think what confused me as well under b 2 a it says however in certain situations the board May hold fully remote meetings for work sessions monthly meetings so I guess it um we are allowing is is there any conflict between those two parts there a Ty it should be or there that looks like a typo it should be wholly remote meetings or work sessions it doesn't necessarily answer your question totally because you're making the distinction between a meeting and a work session but that is actually I think just a type of where can you can you just say that again what it should say it should say however in certain situations the board
May hold fully remote meetings or work sessions monthly meetings committee meetings um I guess it's actually should be probably a comma remote meetings comma work sessions comma instead of a SO meetings comma work sessions comma monthly meetings comma this is like a very exhaustive list um I think the language that you referenced in C3 is more generic and and it's certainly intended to cover those regularly noticed meetings that appear on your website both your work sessions and your regular meetings okay now now I'm confused because the four makes sense for me here you said four should be or no it it this is a list of kinds of meetings right so the the board May hold fully remote meetings comma work sessions comma monthly meetings okay
y'all are talking you're both saying the same thing um you're just saying it differently okay so four does make sense and the list that follows comes after it okay and the the fully remote meetings you see what I'm saying I'm sorry you're yeah it's where the list not a typo actually there you go sorry it is it is correct sorry sorry it's okay now we have greater Clarity and I'm listening for understanding you know I need to do a better job uh my only request is that we clarify since we distinguish work sessions and monthly meetings here that we say can we say regularly scheduled board meetings parentheses work sessions or monthly meetings so that it refers to the same so are you referring to in C3 C3 so I think the difference absolutely like I can add that and just provide the full list I think the perhaps the difference is in C3 it says board meeting right and not monthly meeting if you just said board monthly meeting you would be correct that work sessions
would be excluded but I think we always want to be clearer right and so in my understanding that you now want in see3 the same list so that the language tracks not or similar so it says work sessions and I just want some clarity that it is uh work sessions or monthly meetings since they are distinguished here I will add that okay I think the easiest way to do that would language to track the same in both places but but not the committee meetings piece is what R is gonna say yeah exactly so I don't I don't think so I think that three is intended to cover is intended to cover your board meetings and work sessions only it's not intended to limit a board member's ability to participate virtually in meetings that get scan scheduled um around the schedule that they may not know about a year ahead of time so I think the idea is that for your meetings that everybody knows about ahead of time you get three virtual
meetings but you could do an unlimited number of specially called meetings remotely is the idea in the way this language is supposed to read so I I think that the Dr giovan's proposed change would would address that thank you okay I have another question but I go ahead sorry it's just a follow up on that I think the defining regularly scheduled actually is what we should be working on because it could be work sessions it could be meetings it could be our joint meeting with the county commissioner I don't know right but how do we Define regularly scheduled is that the things that are on our agenda when we approve our Board calendar in July I think that might help clarify the other pieces that you're talking about then because there's a more meetings than just work sessions and monthly meetings you know this job is but then does that um committee meetings are also regularly scheduled for period of time does it I I'm all into the defining what we mean here so but I'm
just um maybe joint session joint meeting should be added to that list I to me though this the list was a this the list that you all are referring to up here is different than bottom because the three is about attendance at a regularly scheduled meeting not about whether you can have the meeting all virtually or not the list in the earlier one talks about what type of meetings you can have all virtually if I'm tracking this correctly so the attendance tracking attendance in three the question is how many times could I as a board member be virtual and what meetings count towards that or not towards that am I okay yeah that that makes sense this one is about attendance then isn't it only the work sessions or monthly meetings it's not any other type of
meeting well I think the clarity is what we're looking for okay what is what is defined as regularly sched what meetings are included regularly scheduled is it just work sessions and monthly meetings is it joint meetings also because they're regularly scheduled like how are we defining record Le scheduled okay are but are you suggesting that we Define it a different way I don't think it's defined at all regularly schedu so we can address it however you would like I think that at least when I was reading it and thinking it through I was I thought you were talking about basically your 24 Main meetings your work session and your and your U regular board meeting that you do twice a month those are the ones that I had in my head as being part of that three count um so if that's what you're asking for Clarity on Dr giovan and I can easily make that change um if you're asking for something else then we just need direction from you
that makes sense to me yeah board me does any other board member have questions question or comments thoughts on this Miss bu do I I appreciate um clarification on this policy I think it's important for us to um to set the expectation of trying to be in person at all possible and I and I appreciate that language I know that the technology is available and accessible um but when five of us are in the room and two of us are virtual it is less than deal because we can't see each other fully we can't can't um acknowledge you know non-verbal things that go on in meetings and and it's just a it's a substitute but it is it is less than so I I appreciate kind of ways to both modify this policy so that in in limited circumstances we can use the
technology to help us um if people have concerns about the number three in the absences thing I think that this would be a good time to talk about that before we move too far forward um but I do appreciate the clarity going forward um as as y'all have helped word Smith this better you miss Le Miss Lewis she didn't have a question I have a question I had a I had a but with your rambling statement I would say um and this to this board's discretion it says through three absences in the calendar year you know that new board members are sworn in July on the Academic Year I wonder if you all might want to consider making that change from the July to June opposed to the calendar year I have no skin in the game just something for y'all to consider C1 I think is
C I think it's stated a few times throughout see it in C3 also maybe we just check for that do other board members have questions or comments they'd like to make Miss Rogers I think I I want us to have a more thorough discussion about whether we want to change that from calendar year years um to Academic Year and when I think [Music] about um when I think about participating remotely from an accountability standpoint it seems like something that people would need to be able to kind of sort of the public should be
able to track whether or not we are um attending regularly and even though our new members our new colleagues are not sworn in in July generally filing is in November and the accountability period is in the early part of the Year either January through May or January through March depending on how you look at it so if you were to change it from calendar to academic then the voters have less of an opportunity to review an entire year because it's more like the academic year which is just kind of overlapping six months but I don't that's just the way I look at it I'm not sure if it's a strong enough reason to keep it at calendar Miss Chávez
I think I like the idea of changing it actually to Academic Year because I think we are sworn in in the summer and my head Works in academic years and and all of our brains partly partly do because that's how that's how that's our flow of this work so I like changing it um to three of for the Academic Year thank you Miss Lewis for that suggestion um and then I also have still a question um this is on the second to last page F special rules for remote meetings uh quasi judicial hearings what okay I'm sorry I answered my question all right that's my only comment I don't
have a question yes Miss Umstead before I make my comment I just want to make sure if the calendar piece was clear I don't know that I have a strong preference but I do think it would be helpful for every board member who is good with moving to a school calendar type year maybe like a quick thumbs up so we know what to do and by school are saying July to July yeah July to June July 1 to June 30th yeah okay all right thank you um I just wanted to follow up on my comment before I think what I also was trying to state is that if we put the whole list of meetings like committees monthly meetings work sessions in that which is in two which is in B2 if we were to take that whole list and
include it in two oh excuse me in three it would expand the different places and I think they're actually meaning two different things so about the regularly scheduled versus all the different options for board meetings so I don't know if I was I didn't make that clear before are you asking us to include that whole list I think there was a question of should that whole list be included the bottom and I was saying no I just wanted to clarify my comments were about not including the whole list in that sorry I do need Clarity on the um what meetings are included so we said regularly schedule would include your monthly work session monthly board meeting and the joint meetings between the board of County does it mean that okay talk not the joint meetings just what we talked about before work sessions monthly meetings yeah that's thank you the finding regularly scheduled as joint I mean not joint board meetings board
sessions Miss Byars I have a question for um Dr Tanya javani um for this policy remote participation um we assume that the default interpretation everything is going to be like uh provided for for those meetings if if they're open right like if they're so I'm just thinking in terms of the setup like this is just a policy for us to be able to do that but if there's an acknowledgement that it'll follow the same rules that we we have here like for example we have interpretation for every board meeting that we have and if these meetings happen you know remotely um that we will have an interpreter that that information will be posted to the YouTube uh website all the things that we provide in person will be provided remotely for those meetings if they are public open to the public make sure so what it is saying is in the event that there's something that happens that the board has to have a virtual meeting it would be my expectation and I deferred it King with the um translation in the MRC that it would be done almost identical to how we
did it during a declared emergency that would be my expectation per see any difference in if there's a way am I understanding your question my my concern is the community sometimes feels like this mic is kind of weird can you guys hear me okay sometimes like the the remote meetings like there are community members who may feel this is a little more um uh that these Services may not be guaranteed and so I'd like it I'd like for it to be codified and and that there's no in terms of quality remote meetings and inperson meetings we will provide the same um the same setups the same expectation there will be interpretation um these meetings remote meetings will not um be a lesser quality than the inperson um Miss Rogers I think my question is and maybe
rad and Dr Giovani can chime in on this just because we're having an open meeting doesn't mean it's streamed so it did under the declared emergency statute I think that that is now that you're not operating under that I would defer to your board attorney on you know what his recommendation would be for y'all but that was a requirement under that statute during covid but now that it's kind of just underboard policy and it's really not that clear I'm just going like the school of government has the law is a little gray on you know where virtual meetings exist versus go ahead go ahead R if you and I just add one last thing this is this policy is about board is about remote participation it's not about remote
meetings it covers both so one of let me I want to add have you Reas your question if I don't answer it if if the board meets wholly virtually then the public has to have the ability to view the meeting in some form that typically has been streamed by most Boards of Education in some form of fashion if you meet holy virtually if a meeting like today you're meeting here there's not a statutory requirement that you stream this meeting because you're meeting here and the public can come here to view this meeting if a board member or two participates virtually during a meeting that's held here you're not required to stream that meeting because again you are meeting here and the public can come
here if they want to view the meeting is that help that helps and that's perfect sorry here being wherever we notice that the meeting is being held not necessarily here meaning the Fuller building correct correct that is correct perfect now miss Giovani or Dr Giovani I'm sorry to miss faar's point this streamed meeting will interpretation Services holy remote meeting will interpretation Services be made available online through the stream I am not the technical expert on what is currently provided but and I think that's what she's trying to get cified in policy so that's I wrote down codify provision of translation during holy remote meetings and so I would have to clarify but I'm I just don't know what the translation is as provided during the streaming that's great okay
us having a better understanding of that will help us decide how often we use that and activate that because we're already like taxing our folks and when we do that so but thank you I will have an answer for you when I bring the policy back Miss buer so so appreciative of bringing up the need for language Justice and I also believe there are pieces in this policy that are for priv uh confidential hearings perhaps a student transfer where um and so I don't want the language for the language Justice things to be incurring additional burden or expense for the district if we are just wholly like having a confidential hearing under remote participation right and I think that is part of why we are also modifying some of this and obviously if it was needed by the family in a closed meeting we would have that and provide that but only for public right so that
public yeah I don't know what I'm asking but I don't want as you modify this to box us into that um for confidential meetings right that that that are using this technology is that I I think I said public when I was saying I I mentioned I was very clear that this would not apply for confidential so Dr jaavan I think we're you understood what I was asking not asking for us to break laws or expose anything that's confidential but just I said the public ones the ones that would normally be available to the public here the Open Session meetings um yeah so maybe it'll it'll say Open Session meetings um for them to have the same amenity the same setups interpretation what we can provide here uh remotely but we won't compromise on that Dr Jani can you review with an eye towards those concerns okay cool yes Miss shavez okay so on this point I'm looking at um
policy let's see this is 403 interpretation and translation of policies for students and parents um but I wonder if there could be a reference I I leave it at you know up to you it does it make sense to have a reference to this policy which says that the school system will provide interpretation and translations of pertinent school system information and policies to students and parents right in accordance with policy we that one yeah Dr Gman are you mean I think I think I think that we'd have we need to cross reference with that policy to see are we currently doing what that policy says that we're supposed to be doing and if that expectation translates into where there are remote meetings as well we just we just need to I think cross reference it and then if we are we would be assuring that continued level of service through this policy in accordance with that other policy so
they track into each other yes okay any other I have a totally different question comment um I was curious about uh let's see section B number 2 B remote participation by individual members and um the last line of that where it says if both the chair and vice chair are participating remotely the chair may but is not required to assign a member to chair the meeting and I was just wondering why it I'm trying to imagine what it would be like to chair a meeting like being a remote person and wonder in since we all take turns chairing work sessions anyway so we all know how to do that why it wouldn't just be that the chair would assign um a member to chair the meeting if both the chair and vice chair were remote but maybe others have Tanya handed the mic to me because that was my change so I mean you can change it back I I just it seemed to me
at some point that the chair would just chair the meeting I mean if you kept if the chair is not available I mean at some point the chair would just chair but if you want to change that I mean that's perfectly fine I I just was trying to deal with the reality of that but it may it may be EAS the easier reality may be to just continue down the list until someone will chair the meeting so that's fine but that was my thought that was my change so feel free to tell T to change Dr Giovani to change it okay did other board members have thoughts about that I'm not even sure you're in I think it's really hard to share a meeting virtually when you're not in the room with the speakers and like we need to make sure that a human that is in the room can chare if that ever came to that I it's hard to hear the public comment it's hard to hear um and cut people off yeah I think yeah yeah not cut people off manage the manage the meeting um
that was what I was saying does anybody feel differently than that and feel strongly that it needs to be the chair Vice chair um chairing the meeting even if they're remote okay do we want AUM we do a thumbs up for St thumbs up for changing this to shall assign a member to chair the meeting instead of May but not required does that make sense Dr gan's original language prevails okay any other discussion okay only that it seems that there might be enough substantive changes that we are going to bring this back is that how we're yeah thank you right I I was just referencing this was on the on the agenda for action but it is now for discussion right now that it yes it was for discussion and typically if it's if you didn't have any changes

changes I understand the changes that we're asking for and I'm excited about those I want to make sure we get those before we approve but could we do something like we did in the superintendent search where we um wave make it so that we can do those quasi [Music] hearings remotely in the so that we can get them done before June 27th wave the policy um do we want to hear about our options from our attorney yes or we can do this motion if you would if you're thinking you would need hearings between now and when this would come back in two weeks you could certainly wave the requirement in the policy that you not have that you're prohibited from having holy remote meting meetings for any student transfer appeals that may need to be

changes made that um I'm aware of if I recall incorrectly Dr lay let me know so um if you recall this is really just kind of the principles they did um change the name from salary Administration to governing principles for salary Administration in the working group The dis decision was made to present and work on a second policy for the board I believe that we had initially shared with you that there would be this policy and then Administration would work on rmps for a salary Administration policy and then after we met we've met two or three times three times now the working group and as part of that um group it was determined that given the um importance of this and just the kind of the heavy lift around salaries that it be something that is brought to the board at a policy level so we are currently working on policy 7502 uh salary Administration and
employee compensation and it's multiple multiple Pages um quite detailed and I did want to share the list of the working group just because they are um really committed and so um the members the leads are myself and Dr lay uh Dr Dietrick Danner senior executive director for federal programs and Community Eng engagement Miss Kim Hager senior executive director for human resources Mr Frederick Davis Senior executive director for operations and Building Services Miss Jennifer Hower principal at Easley Nisha Watson PE teacher at Eastway Margaret major EC teacher at Lowe's Grove Middle Ronda kulie data manager at Jordan high and just want to give Rhonda an extra special shout out that she is just a really been a rock star on helping us with the language and just really kind of moving this work forward and giving it just a lot of attention so thank you Rhonda uh Mr Jose Cruz art teacher at
Shephard mle Miss Laura parrot director AIG Mr Daryl Monro CTE it manager Mr Pablo fredman director for the multilingual Resource Center Mr John Strobel supervisor for transportation maintenance and Mr Kent Eastwood a general maintenance tech so that is our working group and we are currently um when we initially thought we were just going to kind of bring you one policy we had thought we were only going to meet like three or three times but since we've now pivoted to the bringing you back a second policy that work has gotten a lot more intense and so we are now going to be meeting on alternating uh Wednesdays or Tuesdays alternating Tuesdays or Wednesdays um after the 4th of July so it is um we do anticipate bringing it as soon as possible but our conversations are very in-depth and very robust and just making sure that the voices and how the salary Administration
and employee compensation impacts all different folks I just want to say that this team are not just kind of in their own little silos like they really are lifting up things that they've heard from people that work in different departments so um but ultimately what we're bringing for tonight for um first reading is the principles for salary Administration and then ultimately once that's um done we will bring back a more detailed policy 7502 for the board's consideration happy to take any questions thank you Dr gvani colleagues any questions or [Music] comments if I could just make one additional comment um I think it's really important as we work through this policy and you see and understand more what a working group might look like around a task in the is in in in an issue in the district that
that perhaps this becomes um sort more of a standard practice and uh an opportunity for an employee engagement on different issues that impact them it is harder to do this it takes longer to do this but you have greater investment buyin and product when you're done so something to think about Miss Rogers um thank you for working on this uh policy Mr crfi Dr L Dr Giovani and all those team members that you spoke about um I know we are talking about making this policy can you share a little bit about if this will be included in the employee handbook how quickly it needs to be approved in order to be in next year's employee
handbook things of that nature good evening I'll take that question and so we are actually working on the employee handbook now um anytime we should be able to have that um obviously it wouldn't it would with this being first reading would not be ready for the start of our year round schools but it would probably meet the timeline for our traditional schools um also in years in the past if we have adjustments that are made to the employee handbook then we just communicate out that additions have been made so this is something that we could do that would even take care of those year round schools just for clar apption this policy the governing principles is the one that's here that's the kind of 20,000 ft were you asking about this one being when it would be ready or when 7502 which has the details around like stiens and all you know
assignment to pay grades Etc that more detailed one I just want to make sure that we're answering your exact question let me let me step in and and okay so this one technically is not fully approved till it goes through second read which would be at the next meeting so if our employee handbook is I don't know paper electronic both it's electronic okay yes since it's electronic we can put out a version of the employee handbook that may not have this policy yet in it if we're trying to get it out prior to the next board meeting where there's final approval and then we can update it with the final approved policy once it is ready since it is an electronic version and through one of our emails to staff alert them to the update in the employee handbook with the policy and a link so that they know that it's there and but I do not think that the more detailed policy since
we're scheduling meetings after July will be ready until after the school year starts and in similar fashion once it is fully approved by the board we will need to notify staff that the employee handbook has been updated with additional information and I really do think that that policy may require little 10-minute video or something that goes with it for people to understand what it is and that sort of thing um not just the notification maybe that it's gone out and and since the board will be reviewing it as well it may be that portions of the presentation are what we share with staff so that they can see what's in it and that sort of thing um but it's going to require I think a little bit more uh socialization that's helpful thank you oh yes my Miss Battis thank you um I have a u just a question for this board because um this policy is about governing principles right it's it's the the tenets of how we're going to do this work it may include a committee it may include you know um all the things updating our our
um employee handbook and all these things my question is what's holding us from waving second reading on this one it's about about the principles why can't we just wave second reading approve it tonight and that way we ensure that it's uh timely that we can do the work that we need to do timely thank you U Miss buer I really appreciate y'all bringing this here and happy to talk about waving things and moving it forward the part that gives me pause is um whether we need to Define more clearly salary schedules that ter minology is used throughout here so much and I know that we've had such conf such harm done with the notion of steps and Longevity and state longevity and so I don't want there to be confusion amongst our employees presuming and assuming we're
going to pass something that has steps that are defined where everyone moves every year that I think is a major thing that is still up for discussion and debate and did y all have conversation are you continu will that be part of the following policy as as well that's that's the part that gives me pause about the language that's within here uh yes in 75 the current draft working draft of 7502 salary schedule is defined as refers to a board approved schedule for determining the base salary Andor salary supplement of eligible employees in the same position classification though it would be included in 7502 yeah any I think that answers it it's just um where we um where we've been so unclear and and expectations have been for us to print
and publish a stepwise schedule I also sorry in here just the English nerd in me gets a little cringey about some of the things in01 two3 where some of them end in periods and some of them do not and so I just think we need to be consistent as we uh as we uh clean it up but that that can be fixed by you all at any time agreed it triggers me I just copied it over from before absolutely can I just throw one last question out there at the very bottom of the policy where it says the superintendent shall adopt necessary regulations to ensure that this policy is implemented throughout the school system is that still the case or will the other policy cover that so I looked at that and until that other policies adopted we don't know correct yeah okay and I didn't want to take it out until I think it okay we'll see all righty thank
you other comments yes Miss Chávez I'm glad I wasn't I have to be the person to say the thing about the periods thank you um also okay the quick thing number two superintendent D missing a preposition there provide oversight for over employee compensation something like that which is two two D is missing a preposition in the middle oversight and employee okay um are we but I I am wondering like are we trying to wait on this than to approve it with the other policy or is there is there a reason did I miss something is there a reason to wait on approving I'm on approving that this this evening no not not from my standpoint I think it depends on the board's Comfort level with moving forward it would be
somewhat helpful for the board to approve it because that guides the work we're doing on 7502 also because the working group has asked several questions and then referred back to the draft of 7501 to make sure that we are act aligning ourselves with the guiding principles would other board members like to weigh in on that question specifically of whether you would feel comfortable this waving second reading or not then yeah I'd like to say that I'd be comfortable waving second reading I do think the I'm I'm glad that salary schedule will be defined um since that can be understood different ways um and that that's coming and yeah I I think especially knowing that it would be helpful for you all in the 7502 development um to to go ahead and approve this I'd like to do that if others are um of the same mind
yes Miss um just making sure that's with these Corrections in the edits right with these minor typographical things yes okay do want to know if I'm reading some of these pieces correctly though this general principles will be shifts like some pretty big shifts in How We Do salary like this steps if I'm and I don't know what's coming next but this says credit for verified experience will be considered for salary placement but it doesn't talk about them like so I think some of that is just really large shifts and I know that this is also a weird time to try to get feedback from folks as the summer is but I wonder if there also needs to be y'all can also tell me this won't happen in two weeks so that's okay too uh like what our policy currently is what this proposes and like very simple language so that folks can understand and be able to engage with yeah we have we have practices not
policies um and and so what oh sorry that's what our practices are that's like why is everyone looking at and I think that's why that's why codifying the language and then 7502 are going to be particularly helpful so that people can refer to and um both be informed and Advocate based on what's in policy so but but so so right now um experience is we we it's not a it's not like a black hole but it is a little bit of a negotiation it is seeing what best practice is talking to neighboring colleagues you know making some judgment calls about what's on paper and through conversation and sometimes what's on paper requires a conversation to better
understand what it is um and so and it leads to potential and the opportunity for there to be differences based on how good of an advocate I might be about or how good I write what I did what I wrote on paper or what's able to be verified and and what I have proof for and and those kinds of different things so I think the in 7502 where we'll be more explicit about how we do that that will be helpful for staff who want to be informed staff who want to be able to Advocate and use policy to do that and for for staff who are coming on board but for also um HR or others to have policy language that guides how they make those decisions so but right now it's practice not policy s okay you finished and then miss Beyer at say so I I think that's my like how do we make sure that this is really clear for folks who are trying to wrestle with it so that would be my question about first reading or second reading my other thought that I would
want to add to and I don't know if it actually makes sense to be here or being the following one is language around when we review the policy on a regular Cadence um because I think that like even having this working group a year from now sitting back and saying how did this play out what did it look like where are The Kinks like what do we need to shift and change and then I think maybe doing that in a regular Cadence moving forward because this is new and it's different and we know when you take something and apply it to thousands of people you find out where the gaps might be and that it it might feel more appropriate for the following one since we don't know what that part is but figuring that out that's my comments so I don't know if that's a first reading changes if we do first or second reading thank you miss patus you know we're talking about first reading or second reading for um and I like the title I am the working group probably thought about a title that just says governing principles to include that right um the title just says these
are the tenants and that's you know 7502 will hinge on that I guess my feedback is that um this is not the first time we see this and I don't remember how we added it to the agenda last time because I do remember giving feedback especially on Number Four Financial Services and saying I'd like to see a little more with that but as I look at it um and just with the experience that we have had in this District um uh 4 a and 4B I I like how this policy makes it really clear the communication is for financial services to provide recommendations to the superintendent so it provides that line of accountability where this information goes to the superintendent and then under the superintendent I guess all the other things fall into place in terms of um so what I'm saying is that we've seen this before so even though this is called first reading today it's not her first reading we we looked at this before and um I can't remember what the agenda title was but we've looked at this so it's technically this discussion item it was just a discussion item we wanted to
provide a long Runway not knowing where this would go so rather than just bringing it immediately for first reading since it was very different from something we done before we bought it just to discuss and then we were do first and second reading at the normal Cadence but given that there's not been a lot of changes and and we are talking about governing principles and the next policy might take a little bit longer I can c see where the board's decision on whether or not to move straight to uh and skip the second read it's your call because it's not changed a whole lot and my follow-up feedback um is that I also I remember having this discussion about extra Duty contracts and it doesn't live here it's not here however um the idea of a committee to kind of talk about when the rules when somebody goes beyond the job description and they're doing way other things and what qualifies as extra I I don't want us to lose extra Duty I think that um there are opportunities where that is provided in some schools some leadership
will do that and other schools may not and I just want that to be really clear in in in our um I I trust that there will be more more changes to policies not just 70 not just the creation of um 7502 um or or the the update to that but also other policies that might talk about extra Duty or um employee um what do you call it employee employee rights like stiens or other kinds of so I think um that work is already happening we are already engaging with stakeholder groups and trying to get feedback from principles to to cry try to create a little bit more structure and predictability to what is extra Duty and again you know I think I may have said last time I want to separate things like stiens and other things want better to Define our terms and and put the structures behind it so people know ahead of time and and quite frankly we should have a defined pot of money with
a defined amount of funds in it or defined um roles and uh amounts for those roles based on either level or complexity of the role or the time of year that it happens and and payment schedules for it um uh so that we know at the beginning of the year how much is in there and we don't spend more than that at the end of the year and and and if there's needs to be discretionary funds available for things that come up that's a separate pot of funds um that will be more limited and um and have to be governed separately but but that work is actually already happening and whether it shows up in 752 with some definition or language or it becomes a a process and a schedule that you see that's adopted um because sometimes extra Duty schedules are adopted by the board same as pay schedules are adopted by the board so
that's There's an opportunity there as well thank you others have thoughts like to make a motion um I would just wanted to say one thing that is in favor of maybe your motion which is I do we've we've seen this once we've provided feedback on it during our last meeting and this nothing in here feels controversial I really appreciate the that this is guiding principles you know we refer to administering salaries fairly and consistently that's not I do and I also think that this is in line with in many ways how we've been doing things it just codifies it and I I love that um and I would like for and I really appreciate the time that you're taking to work with staff to get feedback to make this as strong as possible and I love that that could be a model for ways to incorporate staff voices moving forward in all of the work that we do to make it more robust and
something that supports our district [Music] um okay anything else anyone would like to make a motion yes Miss Lewis sorry for anything else um thank you for clarifying that you know the these are practices that we are codifying um being more clear one of the things I do like about this is every number from school board human resources um Financial Services employees each one of those um positions has a collaboration and specifically who they're collaborating with and there's these lines that I just kind of see like this information Highway of communication one of the things that has been in our practice is that the superintendent has collaborations as well I don't see that as explicitly here and um so whereas the school board a collaborate 1A collaborates with elected local and state officials to advocate
for DPS needs the superintendent does some of that on some level along with collaborating with stakeholders um meeting with certain persons um within our district to give input to the budget so that has been our practice but is not uplifted here so I would like to add a governing principle around our value with the superintendent collaboration with stakeholders as well around the budget basically copy onea over to 2A and then because it is really the same process at at a with different different and same stakeholder groups okay m l would you want additional stakeholders there or would you just want the elected local well when when um Miss Moore said you know many stakeholders I was accepting that um but
specifically you know our Educators also he has meetings with different groups we don't have a budget advisory committee so that and that would be to narrowing from year over year if that doesn't is not kept up so so I wanted to say stakeholders to be all inclusive but if you would like it to be more specific I no I do I do think that the piece that you're talking about is appropriate um I I mean I did it right I I think I mean that's I think that's exactly what was happening is you know orienting and identifying needs throughout different levels of the organization prior to bringing a budget recommendation um so yes I do think that I mean you could you could copy onea or you could and you could actually add another one or extend onea to just include um and and I and I think something here specific um I I I don't I'm not sure if the
school board wants you know stakeholders for me is important but I think it's important for the superintendent but I think in part particular importance to the superintendent you might want to call out separately DPS staff right so you know because those are not exactly the same I want to be careful about lumping all stakeholders and DPS staff together because they are not the same groups um so I'm I'm okay whichever way you land then the the other piece sorry was was also like County budget staff and County leaders that are not elected and the way that this a is phrased kind of narrows it to elected leaders in my reading unless I'm oh I think that that piece is important to add as well would we be in favor of adding DPS staff County staff and other stakeholders or something to onea so I would say this let me and I'm you know I'm thinking out loud here so um I don't know that I would just copy over 1A I think that being more specific
about um DPS staff stakeholder groups you know Community whatever whatever we want to say there because um you've you've heard me say probably before I think electeds stick to electeds and uh and then staff talk to staff um so so I think it would be more parallel and in line with my general understanding of boore duties and responsibilities versus the superintendent um to it not say elect is even though that may happen but that is primarily more of a Board responsibility as elected to elected and then the the the 2A would be more specific to collaboration with stakeholder groups including DPS staff um Community stakeholder groups you know that sort of thing could be like the foundation I mean the number of different folks in the community that could be a part of this yes Miss Chavez yeah I was just going to try to narrow down the language I like what you said I think it could be collaborate
with district and County staff and other stakeholders sorry that was for um 2A 2A a new 2A a new 2A district and County staff and other stakeholders okay and was there a modification to 1A also other board members Sorry Miss biod did you have something that you just clarification um or I'm sorry Rod if we if we add we want to add you know um what Miss Lewis uh board member Lewis uh raised up about um superintendent responsibilities and roles and that including engagement engaging stakeholders engaging um uh district and County staff and other stakeholders um so we want to add that can we if we are all in agreement with that sentence if we read it right can we wave second reading and approve this tonight
so that the work for 7502 and the remaining things can be moving forward can move forward yes yeah I mean uh as long as Dr Giovani has it and can incorporate it which I think she she does I se no reason you can't do that um I'm fine with that can I ask that you bring back the edits with the other policy too just so we see the final version of it in with 752 I think is that right so I just want to clarify that the new to a you're now going to have a through G correct you're not replacing a with the new language okay not replacing okay adding I told Mr Malone that but he didn't believe me so go ahead coming back no I just asked if you could bring this back I know there's going to be a

there is a Cadence not sure you have enough meetings in a month to actually make a dent because there are so many policies um uh and then because you've got two things that are happening there are policies that are that might be just really DPS specific um and how often those might need to be reviewed and then there may be policies that um that come from Schoolboard Association they could be new whe they reviewed usually when they're new they're reviewed you decide whether or not to approve them there are updates that they push out on a regular basis and we have to take a look at those updates as well um so I'm happy to provide some some guidance on cabinet on how to eat this elephant um it is an elephant and um and I I'll just say briefly I think you'd start with your oldest the ones that have been had the longest amount of time since revision um and then deal with that and then deal with the stuff that's being pushed out and updates by School boort Association then you sort of work your way towards
the middle thank you and maybe find opportunities for consolidation well yeah and you yeah eliminating well there's eliminating policies adding new ones um revising policies but um you also you need a sense about how many you can do at any given time also um you know we're doing two today two three today too and and if you did two per meeting you'd be doing this for about 10 years we need to retreat did you have I just want to add a comment on that I would like to see us get in a Cadence though like if there's a five or foure cycle and I I think we will need your guidance from this of how many policies can be if we space them out what's the right Cadence and flow is it in a board meeting like this or do we set up a policy committee that spends more time working through this and I think that we want to hear your recommendation but I would like to see it already be cyclical so we could cuz I was on the board when
we went through all of them and it took a long time but I really enjoyed the process uh and so how do we keep that on a regular basis though so it's not like okay every we got to do all of them this year but we do a set this year we do a set next year we do another set and by the time we get to that original set we're back in the fivey year whatever that cycle is I hope I explained that correctly or that was clear to everybody did that happen in 2016 by chance because I've noticed that many of our policies date back to 2016 I want to say that it had to start after that because um I joined the board in October of 2016 and this happened after Dr Giovani was here so that had to be 2017 18 middle of 2018 I started and then we brought started the transition project January 2019 the 2000s to superintendent Moore's Point are the oldest those were have not been looked at since like 2016 and those are the board policies and so that would be probably an ideal place but I would like to kind of huddle with cabinet and superintendent Moore and then kind of
bring back you know and I don't think it necessarily has to be a presentation but just share you know with the board kind of what a plan is and get some feedback but we've waved second reading on this policy but we've not voted on the policy so I just want to make sure we return to that but yes missp so I I appreciate it I I wonder even if at The Retreat or soon thereafter in July we we hear from you all about recommendations for best practices for for working through these policies because they are very out of date and before you Dr Giovanni Dr Pitman was leading this effort and it is tedious but it needs it needs attention um so if yall have those recommendations to bring to us as we set our new calendar year and whether we need to add a policy committee or something I welcome that input as we move forward um I would make a motion that we approve policy 7501 governing principles as
amended okay it has been um it has been moved and by uh Miss berer and seconded by Miss Battis um any additional discussion about policy 7501 without any um we we we need to wave second reading again I would also amend my motion to say that we are waving second reading that what you needed R yeah perfect okay well we are voting on the policy because we're waving second reading and voting on the policy tonight so for for
clarification the first vote was to wave second reading the second vote is to approve the policy with the waiver of second reading any additional discussion all right let's take a vote all those in favor v i all those opposed all right it pass is unanimously and I believe we are going to um deviate from our agenda briefly to return to public comment we have a late arrival um who I believe is familiar with public comment rules have three minutes that's the one I'll tell you um Lee bardley thanks I really appreciate it Jessica um I'm here I appreciate y'all getting me in late um to ask you to think deeply and sincerely about your state core beliefs I've really appreciated the conversation I've been able to hear being so careful about words um tonight and that's what my
statement is about equity and shared responsibility are the first two beliefs listed on the DPS website these sound so good and I believe that you all want to uphold them but these are beliefs that require hard work and hard trade-offs they only come alive when they are actually applied I've tried every way I can think of but I cannot imagine how you can believe you're applying these principles as you're making your decisions concerning DSA you know that the public engagement around this issue was pathetic I happen to attend the only meeting that was open to the general public about 15 people attended a meeting in Trinity Park no parents or community members who are connected to other schools included in all of that publicity from last Bond were there this level of Outreach is not worthy of DPS or of your well-intended claim to act collaboratively or involve all stakeholders why are you okay ignoring this but it's in failing to uphold the principal of equity that you're really portraying yourselves in the community as you say our students and schools deserve Equitable access to the resources and opportunities they need to succeed during public schools in the community must distribute those
resources in a manner that eliminates inequities you know that your decision to create a Cadillac school which is a term that your staff members have used means that elementary schools who are in desperate need of moldering mediation gas system repl replacement and HVAC repairs Will Wait so while DSA gets Cal Cadillac these other schools will have to drive their beat up Volkswagens getting peac meal repairs and their eventual Renovations will be even more expensive in what universe is this Equitable you have another option you can choose to actually evaluate the plan but fored by durm for DSA as a case that has a case that has become even more compelling as more information has been gathered we can create a lovely learning space for students at DSA a really nice Honda and let our young and poorer students also have safe functional spaces maybe we would call that a Toyota I can't extend this metaphor too far but when I was on the board I often had to tell constituents that although the
needs of a particular school or particular student were important the role of the board was to make decisions that considered the needs of the entire system and would benefit the greatest number of students especially our most vulnerable students board members are called to have this broad systemic perspective similarly you are called to have a longitudinal perspective Imagining the long-term impact of any decisions you make this decision will Ripple through our community for years as new local taxes are needed to cover the shameful neglect of our general assembly and new bonds are needed to repair our substantial inventory of older schools and build new ones I know you guys can do this thank you thank you yes Miss Rogers I know that we generally do not respond to public comment I I really appreciate um us making time for Miss borley and other folks to come and talk to us about DSA but I want to make sure that we all understand that there have been multiple
meetings with Educators and Community one that was held at DSA with Dr mubanga The Architects um showing the rendering we're current um current members of the community as well as members of the PTA parents were all there talking about the differences in the in the two spaces they couldn't hear Mr Davis very well because of the sound not being very sufficient in Weaver Auditorium because of the age of the space there have been multiple meetings with teachers um in order to get feedback from the community in this iteration of the board and in previous iterations of the board but I appreciate everybody coming and sharing their thoughts but I want the community to be clear that there has been multiple opportunities for people to give
input okay so we'll move on to the next um item on our agenda which is the uh theou between DPS and Durham County Sheriff and it's me again welcome back so this item uh board members is on for information just historically if you recall about this time every July uh the superintendent enters into and the sheriff um well the superintendent design and the sheriff and designes enter into conversations around theou and like how many SRO are going to be in our schools and what schools they're going to be in last year there was um conversation on the safety task force that was outstanding and we were waiting on that report and we did receive that report um we did review it um both internally here in Durham and with the
sheriff based on um those conversations as I indicated internally and externally the decision was made to recommend that there be no substantive changes to theou and its current iteration as many of the requests and the feedback from that safety task force are already being done under theou and within Durham Public Schools um and with the sheriff's sro's I have provided um at for your review and the publ review an addendum with supplemental information that indicates kind of some of what those primary areas were if it's in the board dos um what some of those areas were and that it was determined that kind of that feedack back those are being addressed but I will say that um the conversations continue um with um Safety and Security and the sheriff's um office as well so as I indicated this is for information the superintendent does
sign this um and the sheriff does sign this as it expires at the end of June thank you thank you Dr javani I'll open the floor up anybody have comments or questions yes Miss buer I appreciate um you while bringing this here today and um this board has been waiting for years for feedback from the safety and wellness task force that is a Joint Task Force empowered by city council County Commissioners and this board of education we have continued to uh await the support from that group of community members with suggestions specific suggestions on how we could do safety and wellness better in our community and three of the
recommendations were specifically directed at our schools and at sro's so I am here today frustrated that we suggested revisions to that language and codification of what our community asked for that were not able to be incorporated by and and we're recommended by our staff and and by our safety offices so um I'm frustrated and also acknowledging that we need um to move forward and do not want to delay the start of school um so I'm wondering as a body how um we can sit with that tension and also accelerate these conversations and perhaps revise this in
in the coming months um because it is a living breathing document but but the voice of our community is strong I appreciate the the language that is here and that what you all suggested DPS and agencies shall jointly coordinate and continue refresher training for SRO to discuss an overview of restorative practices and exceptional children's services on a biannual basis and annually for the new SRO to DPS shared values of this community through and through second one that that we wanted to bring forward the superintendent or his or her design shall collect feedback from the principles at least annually regarding the SRO program and provide feedback to the agency regarding the SRO program and the performance of the sro's on an annual basis the executive director of Safety and Security or his or her design shall collect feedback from SRO supervisor or his or her design
regarding the SRO program and the performance of the SRO on an annual basis all things that we can and should do in durum in our community then the third recognition was celebration of the heart team and how we might in the future continue to involve the heart team with children students adults staff that are in crisis within our schools so I look forward to this board um discussing ways that we might continue to elevate these values these shared values and um and and recognize how we how we move forward um but I but I am frustrated that this was not able to be incorporated um this year um and I and I sit with that tension um I'm and I'm so grateful to the community members we appointed to that task force and frustrated on their behalf and our community's behalf
um and I I don't know what to do with that today but I wanted to share that thank you thank you next Miss Battis I'm going to take a point of personal privilege on this one um I think I understand that this mou comes has come to us year after year even and even before I was on the board I was a part of a task force um the education committee board member Lewis myself and many community members um has you know emailed the board at that time for changes to theou and that's one effort that I was involved in but then there are other conversations as well about how to improve this mou I want to the reason why I want to
take a point of personal privilege is because I need us to understand implications in the future um there's a there's legislation andc house floor um a lot of families in Durham public schools are fearing what's going to happen with hp10 and I'm I'm actually trying to convey to us that the power of the sheriff and his deputies could impact the safety all the core values that we have about welcoming all children who Federal legislation the federal law says that they are entitled to an education no questions about their immigration status no questions about that and I want to read to you what hb10 is supposed to do um I will say and I will applaud our own Sheriff you know for um for taking a stance and saying you know that he doesn't agree with this bill and that is a very important thing to notice um families have reached out and they're like you know they're trying to move out of Durham should be moved
out of Durham because if this happens our SRO who work under the sheriff's office will have power to ask documentation status and we already saw some of that with Riverside with five families who felt like their documentation status or assumptions of what their documentation status was affected these students and many of them had to leave Riv her side and actually some dropped out of school so those numbers that we saw we went in graduations they're painful because you know board colleagues and I were talking about the numbers of um kids who did not make it to that line hb10 right now is in standstill it was uh upward concurrence vote they're going to do a like a committee between Senate and House to discuss the implications of this what does it tell the sheriffs that they have to do and what are the penalties if they don't follow this law and I am very concerned that if we don't add something on there or if we kind of hold off on I know we want this to I we want this before the school
year but we have to put something in here that talk talks about implications to the safety of of the kids including immigration status something about immigration status needs to be here and another thing that needs to be on there is grievance not once in this document does it say grievance but if families feel that they're being profiled or targeted by an SRO one individual and that there are concerns they should be able to have an Avenue what are the Grievances with stakeholders the families the most vulnerable bringing grievances about treatment about profiling about discrimination I'd like to see also and I entertain a conversation about where we want to see that but I I do see that you included that DPS staff can provide feedback it's just not clear how that path goes what are the steps who goes to who you know where do parents bring that to the sit team do they bring it to the principal and then the principal brings it to the superintendent like I think that that's something else that I'd like to see Grievances and also an acknowledgement
that immigration status is not something our SRO needed be doing in our schools because we have due process and that was a policy that many of us came to Advocate and you know some of you who are on the board remember that we leted the hallways and we said that wiing aosta a Riverside student was apprehended and taken by ice and we actually with a lot of teachers Dae teachers I shouted Dae last time when we talked about this went to Homeland Security and met with the chief I mean we met with the people there who um we wanted answers we wanted to tell them don't mess with our students we need our students to learn and be you know get their education we need them to have those civil rights of 1964 that says that there should be no discrimination on any of these basis and so it's important to include those two things how to do grievances but also how to make sure our students we don't violate their their rights under their Civil Rights Act of 1964 to an education to come to the building and feel safe
I'll just say a couple quick things um these are like parallel conversations right this s is one thing but there are values and rights and Durham that's sort of embedded along this parallel conversation um couple things uh I think where we can lean into what we can lean into we should like I I think hb10 notwithstanding there is currently anyway some language around how I um engages in communities uh where there's language around sensitive areas or something like that and we need to sort of boldly move forward with anything related to schools is a sensitive area I think that's that's easy but I think we need to make those connections for our principles they need to be aware of it remind them
so that whatever does happen here we are aware of other things that are in place to help protect our students so that we're all well vered on how to engage should a situation occur um I also think that um with regard specifically to the SRO mou there is nothing in theou that prohibits us as a district from doing doing some review Gathering some data presenting on it publicly towards the impacts of some of the changes that we would want to see in theou whether or not we have the collaboration of our law enforcement partners with it um we can speak to principles and and and gather data on SRO interactions and provide an overview of that to the board um we can you know like with the the recommendation around on heart you know the the law enforcement has nothing to do with heart but we do get we do know when there's a
heart team on our campus that is reported to us so maybe we can provide data to the board on how often that is happening and some broad categories that still protect you know student rights about the actual incidents around what's actually happening there and what that what that looks like on our campus so I I it's not the same as having the language forly added to anou that I'm not even trying to equate the two um I'm just just trying to to to go into a space of what can we do as a district um part of it is to lean into the protections that do exist and make sure that all of our principles and School staff are aware of them our families as well especially with with regards to this whole like I think this whole sensitive area discussion is really some some place that we need to lean into and make sure our folks understand that language and what it means and when you can say no to somebody um and then of course how we take the the recommendations from the community task force for what we can do as a district outside of theou that helps achieve some of those objectives so I have a followup
to your comment probable cause is my only issue that you can say we can say these are our values these live in our board policies we are a district that welcomes All Families we have so much about Equity when it comes to the technicality of an SRO being on campus and having probable cause I mean that is a broad that is that is a door and that has already happened it's Vehicles were searched under the presumption you know show me your license and other things that happened other conversations according to the students who actually met with the former superintendent and shared um what they had experienced and and the moms shared what they had experienced in terms of the questioning about you know Li why can't you get a license and there are a lot of things that we need to avoid um my thing is because of problem cause I I want this mou to reflect specific policies that refer to due process I think that that is a very important um policy to have because it requires a warrant it requires a warrant so it's it can and also I want to say something about sensitive locations in
conversations with Homeland Security folks there's nothing by law there there's no penalty for trespassing a sensitive location the case of Samuel Bruno he was in a church a church is considered a safe a safe location and guess what happened we know what happened you know there there were a lot of arrest a lot of things that happened when the church you know moved for anyways we can talk about that later but sensitive locations are not respected they are a an implied desire that's not to say that they're codified in law that that will prevent a person from doing either profiling probable cause trying to figure out things about our families and so I would like this mou to include our policies about due process about um Equity um um about you know fape re inappropriate public education but that is a tenant we do not want any of our students to drop out and I have to visit those families and look at them every
4% of all law enforcement referrals during that time period that percentage um concerned me and so I'm just pointing that out um here because I think a lot of those students are um at well we
don't know what what grade level they're in but um presumably some of them are newcomer students who are um who who are immigrant students older students but is there a question of if this mou can be modified at this point um at this point this is theou that this Herff will sign I think that's as plain as I can say yes Miss Lewis um so with the supplemental information I just want to be clear that first of all I was the board liaison with the safety and wellness task force and was happy to be of service they did an amazing job um with their community outreach and Gathering all the Community Voices and they were just very VAR s uh several subcommittees working on different parts of the work it it was a
huge Beast to to take care of and particularly with our school and the SRO having to refocus a little bit um we did get these recommendations and um I want to I would I did go and look to see where there is congruency with the Lan which has already the in the um in theou and I do see some of that with some of it so my first question is this being supplemental information is not I'm assuming is not directly included in the way that is written here but it's supplemental information for the board that these things are happening is that what that means I would say supplemental information to the board so that you can see the effort from staff to make recommend recommended changes to the m that we're currently not in theou and to provide an opportunity for that discussion to happen here okay so then with the first one the article
to well okay let me finish let me add one more thing to it no actually I see it there go ahead but I have a question so it is the case we wanted you to see the recommended language and but then at the bottom it talks about how some of these things are already happening right so it is the case that we have done two trainings this year with s r are specifically around the first recommendation so that's happening the sheriff just wasn't interested in putting it in anou okay so and therefore it was deemed n necessary because it's already happening okay yeah that answers my and I see it here now you you referenced number six and number four and that's exactly where I saw it I found it on my own first then I saw the cliff notes here so and in that it just the only thing that's missing is the restorative practice and my question my next question was going to be has someone spoken with the sheriff's office about restorative practices being included in the they've done restorative practices and EC right they've done both I know the
disabilities is in there in theou but it's restorative practices in the for the training like I know I don't know if it's in theou I don't think it's in theou but the but trainings have occurred gotcha is what I'm saying which is the work is great right um the policy for us is what is going to be longstanding and my question was had you spoken with the sheriff and you said you spoke with the sheriff's office and they want to keep it the way it is without adding that restorative practices even though they're doing it I get it but policy is what sticks and not just the practice for longevity so thank you for the work you all are doing and sharing this information with us um my other question was about the data we always having um inconsistency when we receive data I know it say on an annual basis but we don't have a I would like that to be more specific when are we getting data and although it's on an annual basis this is separate from the
sheriff's mou having a Cadence for ourselves to get the data more frequently before the end of the school year so that um just want to see if I get a thumbs up for more frequent data from DPS so let me just say one quick thing so um we can Pro we can look at the data that can be collected about um law enforcement engagement in schools from like what we know about in school studies the the the ultimate owner of this data really is the law enforcement agency that has it wherever it happens because it doesn't all happen in schools doesn't mean it's not impacting schools but it doesn't all happen in schools so data we would bring to you from DPS would be data that we are aware of and we know of because of interactions or incidents in schools if
there are other incidents or interactions that have happened with our students outside of school we wouldn't necessarily have that data so I I don't I don't know how to reconcile that because that would that would need to come from the law enforcement AG and I just want to be spe specific when when are we getting that annual data is there a Cadence just say annual andou but well the the the um highest level of data that you receive is the discipline report that talks about like weapons on campus and how you know that that sort of piece that happens and that that happens once a year um we get it monthly well you get it monthly that and that well actually yes you do I forgot about that but the report that goes into the the state come comes out in a report that comes out once a year at the end of the year it usually comes out in the springish or in the in the fall sometime in the late fall for the year before and then there's a verification process before it's actually final okay so which
is why you usually see it in like the February time frame and then my last question and this was similar to what I talked about the hearts program it would be developing anou with the hearts program um not with with theou which is what you're stating here so when it says formalize DPS relations with dorm Hearts um is is that requiring funding from us to be able to do that or is that a program that's already funded or are they offering their services under some other funding is there a financial implication with formalizing a DPS relation with the hearts it would ultimately depend on what the substance of theou is I I don't know what currently we're doing but it is certainly um it would depend on the what the terms are and what would be included in theou I thought you were saying you we are already doing some work with with the heart or you're letting us know when they come in you can tell me more Dr
King I I think the issue here is that the the heart program is separate and apart from the SRO and the and the sheriff's office so it wouldn't be appropriate for there to be specific information in the SRO mou relative to Heart our schools work with the heart program now currently in fact we we all as cabinet members receive text messages when they uh report to our schools and provide service and support to our students there is not currently anou um with the heart program um separately while while that work does continue to go on I I think that there could be conversations with that group as to their openness and interest in creating a separate mou uh but it wouldn't be a part of the sheriff's in uh SRO mou because they're completely separate organizations yeah the heart program is part of the city city city would be a whole different and I recognize that and that's why I just wanted to know that it could be uh followed up with that again
is a request to hear you're saying there's already the actions happening it's not a part of this Sheriff mou it's really another topic um but what was the formalizing look like with them if that's something we want to consider um beefing up in the future thank you thank you uh yes Miss Rogers Miss L thank you for bringing up the heart um and the work that they're doing and including that here um in the future when we get um more information and Report could we include some of um the work that the heart team's doing I'd ideally like to know specifically I think we could provide you with information about the heart program and about their interactions at our schools but my understanding is that the actual work that they do no no no the report that they're doing at our schools I know what they're doing in community yeah no I'm I guess what I'm saying is their work beyond their interaction is is confidential so we
won't we won't be able to provide detailed information about their work but we can talk about the number of times they are um reporting to our schools and the number of our students that they're interacting with yes and more specifically if I can finish my question I'd like to know um if they're responding to all of our schools or just the ones in the city um because that could help inform our advocacy if there needs to be any advocacy around the expansion of the program I know the county hasn't taken it on yet it is with the city and so if we have information about whether or not or how they can um respond to schools that are outside of the parameters of their base that would be helpful okay anyone else before I make my comments yes M said
no okay um my questions align with those of my colleagues which is uh they're about data and also about implementation and so I think if I had to like frame them under one heading is that I'd like to know to what extent what is written in the mou is actually being done and to the extent that we're able to know that um so for example it says the agency on page eight the agency and DPS agreed to convene each semester to identif to discuss de identified data reflecting rates of suspension outcomes of referrals to law enforcement so I guess not necessarily right now but I'm curious to know like when did this last occur and who was engaged in this convening um again is it actually happening are these discussions being had and then what's being done with you know after the discussions um and there's also on page eight of theou review of the SRO program
where the superintendent or design shall collect feedback from principles right at least annually so that's data that we have because our superintendent getting the feedback from the principals um regarding the program and then feeding that to the Sheriff's Office so that could be something that maybe superintendent more could that could be shared with us on these report backs okay um and then I'm curious to know if any SRO were removed from the program in the past year because I see the section on employment status like how many complaints were received in total of past last year about SRO I don't know if that's data that we have access to or not or if that's lives within the Sheriff's Office and it does live within the Sheriff's Office not us well numbers not Personnel um and
then yeah so and then there also I think I noticed what is just a simple error in like a typo on page eight which is there's some dates on page eight there's number five data collection reporting that refers to during the term of this agreement and references dates 2019 to 2020 yeah that one's straightforward um okay um yes similarly I wish there were more that we can do I mean I'm glad that we already doing that this mou contains a lot of what we want to have done but I am always curious to know and I went and looked back at the questions I had this time last year and they were similar which is are we really doing the things like all the training and all of this data collection to kind of monitor the program to make sure that it's helping not harming missad I have many of similar questions and comments that you all had so I won't review them but I wonder under the data
collection and Reporting the agency and DPS agree to convene if there also um needs to be a an addition to hear that the Board of Education and the sheriff also convene or the Board of Education leadership and the sheriff also convene just as in the spirit of electeds to electeds right um because I think there's there's just different types of conversations that you're having when you you're talking with the sheriff in particular or I'm making some assumptions I'm not sure when they say the agency and DPS who are the people that might be doing that meeting and it could be twice year so you know once in the in the change of the semester and once at the end of the year or something so that any things that bubble up we can be having that direct conversation um with the share so I would just say in quick response to that that DPS is not defined you know what is DPS is not defined in that particular statement I'm assuming right now that it's occurring with DPS staff in security who meet regularly um
to discuss those things but it it you could certainly interpret it to be more than DPS staff and um and it could be a a sub commmittee of the board um or it could be a report that comes to the board as a result of that the staff meeting but I think that direct engagement with the elected can be accomplished through the language in this mou the way it's written um through a change in practice have more or if not Miss Miss viatas um on that comment that my colleague uh Bettina made Communication in in the experience that we had families met with Dr mubenga and Dr mubenga was communicating with the sheriff and that communication was key so that months later almost 5 months later something was you know addressed about the situation there and
I and I do think um I do I do I think I have gratitude that um I haven't currently heard that any of our SRO are profiling and harassing and causing kids to drop out of school or to be in the hospital for a long time which is another situation that happened so we don't have that situation right now but I do think that in the communication piece I wouldn't want to limit it to just the board with the sheriff because I think that the leader of the school if if the community is asking the superintendent of a school district to please take notice of something that is happening and and and I and I also want to say I have gratitude because I know how how technically difficult and complicated this is because as we know employees have rights somebody who may be profiling may say especially in in an atmosphere of hb10 saying I'm doing my job you can't touch me because I'm doing my job and you know there's state law hp10 we don't want hp10 to happen and I'm not I'm not calling at it I really
think of us need to be very aware of the implications of hb10 and read about it and listen to the families who have who are terrified right now because this bill is just a different number but it's been SB the Senate bills that have happened before and we just keep seeing it over and over and over so it's persistent and if it's not hb10 it seems like there's going to be another number we know that Natalie like it just happens all the time so I just want us to be able to have communication between the superintendent I do think that that it is important um because families can't wait um and I also um agree that this mou see we we seem to be locked by this mou the way it is I think that there there are opportunities in what's already written I do think we need to follow that with a statement to families talking about our policies and the ways that we as a district are are putting this this out there like we want all our kids to come to school we don't want them to fear coming to school and then put the policies out there you know fape is also important all these different things so we need to figure
out an add-on to Theus we can approve theou today and then do something that is um will communicate to families about our our culture our policies federal law civil rights you know all that I like can I share something just it is a periodic that I've um you know I did um that investigation um M frar and this board in February of 2016 did adopt its resolution uh regarding ice and that has been something that I frequently print out and share with families when they do Express those concerns so that resolution didn't go away in my estimation it's still on the website so I have freely shared that that this is what this board's um principles are with regard to ice and people's immigration status so I just wanted to lift that up and uh just publicly for staff members that may be new and weren't here just to let them know that that is out there in
the resolutions of this board and how it feels about protecting our students and families thank you let me just they they learn every day more like they just five seconds ago that we have a resolution um we might just want to share that annually at the beginning of every school year well I would take it a little further than just sharing the resolution because the resolution is in a beautiful board speak uh how do we make that in language that is really easily accessible to our families that is bilingual as well um and it goes out every the beginning of the year right in that packet of all the things that you get from families and then also staff have training and all new staff who come to DPS are reminded of our stances and our policies and our procedures I think that's vital because and it and it happens every year almost to the point where you're like I know what it says because I have heard it every year and we need it to live within the people so when incident happen it's quick to come back to memory um and I also been
following hb2 and it sent uh superintendent Moore a message to say how can we really quickly get that messaging out to families because I know that it's already talk the talk is already happening in the community so we have to be ready to go because year round school start in July so the families are going to be ready to go I want to come back to another point that you share Miss Vadar is around like a grievance procedure and I do think we need to get clear around if there is a challenge with someone who do families talk to because I think in the issues that we've had earlier it was not clear who they needed to go to and if it wasn't resolved it with a principal or someone else where their next step was um and so I don't know if that's included and a lot of that is um on our side right that's that's on DPSS side so what can we do to be really clear with families with students um with Educators around if there is a grievance there is an who do you talk to and what are the steps that you need to move to next uh
it shouldn't be that you know somebody who can connect you with the right places thank you I will reference our student and parent grievance procedure policy that hasn't been updated since 2019 so I wonder if that's a space where we can codify some of the like revisit this and codify a little bit more and strength strengthen if needed um the language there well or does there need to be some addendum to this in the future because these are uniquely not our employees but in our buildings interacting with our students um and so I don't know if that I wouldn't put it there I would I think there's another place but the grievance goes to the S we want the grievance to go through our system so that we can handle it in our system right I mean grievances can go to the Sheriff's Office but then they're out of our hands but let me just throw a couple logs on this fire um [Music] um grievance and complaint are two different
things right a grievance is specifically tied to an administrative decision that is made by school system staff that is not the same as a complaint that can be uh levied against a staff person somebody else you know and even and if if a complaint were levied against a school resource officer um I believe that we we would have an obligation to review some of it but ultimately it is the sheriff's office because it is the sheriff's employee Sheriff's not I mean I I've had this conversation with other sheriffs um in a in a district that had 12 municipalities sheriffs don't budge on their employees their process their review and we'll tell you what we think we you need to know you know that's that
that's that's a hard line to sort of get across um so I think it's just it's important to just understand that doesn't mean you don't keep working on it and try to build relationships that are um more collaborative and more transparent but that is that is my previous experience um and and just a hard door to bust down um so first grievance versus complaint are different um and then second um their employees their evaluation I I mean it it can be ultimately quite frustrating I've experienced this as well to say to a parent that their venue for a complaint to be followed down a particular uh issue that has occurred has to happen outside of the school when perhaps the interaction even occurred in the school we are limited um there um and and I just I think putting that out there is
is important and that's really why the the is a place for that but I want to lift up another policy where I think there may be space for review and that's 5120 which is the policy on relationship with law enforcement that's our policy that's our guidance that we give to schools and staff around what that relationship looks like so what we what we are not able to accomplish through anou we might be able to lift through how we engage um in our policy 5120 relationship with law enforcement that may be a pending a review that should come to the board on what's in there and take a look at what you like what you don't like what you want to update Etc just quick follow thank you chair um Jess carda and I have a followup to to that I think um in considering policy 5120 when it comes talks about relationship we need data points we need to ask the students you
know because the relationship could be staff could be but the students also their relationship to the SRO are also important like we want to hear we want to get that feedback and I think that qualitative data whether qualitative and quantitative data like what are the interactions at the school at every school building and then also what are some of the qualitative uh pieces that that can help us you know address relationship and that relationship between students um and every everyone else so I I think that we need to get some data from the students thank you um other board members yes Miss Chavez okay so I really appreciate this conversation and all the thoughts um my colleagues are having and um and the conversations you know leading to this uh so what I made a list of action steps um that I think maybe we want to take or address and probably somebody else has
already made this list too but um I think it's a great idea to set up a meeting between um board members and the sheriff in the early part of the school year um or the summer or whenever um that may happen um and and make those this the uh semester uh twice a year meetings if I'm reading that correctly and um secondly about data collection um parly maybe with that meeting clarifying data collection processes but also um what I'm thinking about and what I think you just mentioned is by that is like what data we collect and so what happens on either side um and what we we might even collaborate on some of it um but you know there can be yeah data collected on both sides and I do see um
Jerm said was just citing the part around data collection what they what the Sheriff's Office does provide um to us uh but we can think about what other data we want to collect and how [Music] um I'm thinking about well I really like the statement um putting out the statement I appreciate what you said Dr Giovani about um about sharing that resolution you know with families when they have a concern um about our uh commitment to protecting um immigrant students and families regardless of their status um I like the idea of putting out a statement uh and um I'm actually I'm thinking as a parallel um should hb10 come to pass um kind of like sb49 and we put out a statement um but you know affirming our lgbtq students and we might need to do a similar thing but I'm also thinking about Beyond a statement um if we should
think about a plan for protecting immigrant students and families and I think we have many um many elements of of that already in place but I also want to shout out I said this say this every few months that I think we should do an UND undoc you Ali training um and because I think there's a lot to understand about and document Ed um experiences and um the experiences of mixed status families um and then the grievance procedure or complaint procedure is something um we need to consider and then lastly the revision of 5120 which is I appreciate that um superintendent more you for um bringing that to our attention so that's kind of the list of things I have here and I also appreciate the work of the task force that helped us to probably um bring out some of the important points
that we need to really pay attention to um with this uh relationship thanks yes Miss dad clarify thank you for that follow-up list I think my request would be and I I think I might even amend it not even if HB whatever happens with hb10 that there's some type of flyer for families around that takes that resolution and the policy and puts it in like a flyer format for families so it's just an easily accessible digestible thing that goes out every year like I don't actually think we need to wait to see what happens with the bill all families should just know this is how dur Public Schools operates um that sound good yes this is going to be short I want to highlight that we have received uh revisions to theou over the years both from the education sub Committee in the People's Alliance that was years ago um led by Dr Ronda Taylor bulock and um Kelly Cosby there were um Katie Jackson mongola um and so many other um folks
and I mentioned that you know board member Lewis myself um were a part of that but then also we got revisions from Kevin Primus um there were a lot of things that he highlighted in terms of especially the school Improvement team I think that that is a very valid way we're going to get feedback and we want to get feedback from families and we localize that at the school the school Improvement team can keep track of you know relationship what are some concerns and and we already have we have to support the school Improvement team as a structure um for feedback and codifying that or not C helping us C put that into policy um I think that that feedback from would be very important um but yeah I just wanted to highlight like the work about modifying the theou with the Sheriff's Office over the years and to kind of um and also definitely the safety un Wellness task force the work that they did um to support some of these same things where they talked about the engagement and the need for more data so they're all in alignment I don't think that there's any anything that has been done with education subcommittees or with um
Kevin primus's Provisions to theou or with um what was the other one that I mentioned um the safety the uh safety and wellness task force I think that they're all in alignment any other comments I just wanted to clarify if we want so thinking about this um establishing a Cadence for receiving data related to the SRO program um from the district like what frequency and what data um board members would like if we work on collecting like a list of information that we would like and compile that and share that with maybe Dr King and U Miss Moore would that be a good first step so that you have that compiled list from all board members and it could be things that we know or think are already being collected along with like wish list items that we would like to be collected if not too burdensome all right okay no further discussion we can move on to the next oh I'm sorry go
ahead think we have to approve it are we here to approve it or no it just is information item thank you oh just checking one okay so next agenda item is um The Early College naming update do you have a presentation for this yes okay waiting for it to come on up I'll go ahead and get started if that's okay um good evening board members uh superintendent Moore cabinet uh thank you for allowing me to be here tonight uh on behalf of uh the office of public affairs and uh in collaboration with them uh I'm here tonight to uh give
5 million to renovate our or expand our middle college program to a full Early College focused on Health Science careers oh we're almost there there we go we can start on that slide this slide uh provides an overview
of the school program uh that uh the the collaborate the collaborative is working to create to expand the middle college too um it will be grades 9 through 13 that 13th year is for the extended uh what we would call Super seniors uh to finish their associates degree we can go back one more there we go uh the four Pathways that will be um um at the school are nursing Allied Health surgical tech and clinical research and uh throughout the students experience they will have interaction with Duke Health um as far as health uh related work Bas experiences um Extended Learning opportunities um so Duke health will be woven all through those um four years or five years that they're there next slide so pursuant to policy uh
9300 we have a name change ahead of us for the middle college the middle college will no longer be those two years it'll be four years um and and these are the suggested names that we have at this at this moment the Health Sciences Early College The Early College of Health Sciences at durm Tech health careers early college early college for health and science durm early college for medical sciences and Durham Early College of Health Science if we could go to the next slide so what we're here tonight to tell you is the process so we um we have these names um over for the next uh couple of days June 14th through 24th the public will have the opportunity to give feedback on these names um the data will be synthesized and then we'll be back on June 27th to present um a recommendation to the board and next slide so um once we have the name then
that will begin uh the intense preparation to promote and recruit students for the school uh we'll have have uh marketing material to create and um branding and that will be created once we have the name so and then just as a reminder we'll have our first cohort of students at this new school um August of 2025 so as you know the next year is a big deal right in November it starts the Showcase of schools and then the lottery season so we want to have all this in place fairly soon and do you have any questions last next slide thank you Dr P all right board members yes uh Miss Lewis you said thank you for this presentation it's really exciting to hear about the Bloomberg Grant every time we hear about it and um the naming of the school I used to have a community engagement the 14th through the 24th and it might be
feudal because we're in the summer months and the other three cohorts of early college students have been out for about a month now but I just wonder if we could do any Target marketing to get their input for the upand cominging school if they be interested but I you know doubt there even checking their emails but if there's any way to reach the students maybe a oh that goes to the parents I don't know um that was my only U thought or question um just getting some student input those that are already attending an early college program and I will say we uh we did a soft launch of some feedback to get names for early college that for the school right after we did the announcement earlier in the year so around the February time frame and we had very little interaction so um but you to your point I'll take that back to public affairs Miss Chavez thank you for this I just have one little question which is how are what is the um plan to solicit the
feedback on the names um so there is a survey that we'll make available on the website um it'll be put out and um I'm sorry that they uh office of public affairs wasn't here to answer some of these questions tonight uh but uh I assume that we'll do a social media push as well but I'll ask them to do that okay thank you missp I so much appreciate yall bringing suggestions and getting this um name started so we can see what looks good on a t-shirt you know we got a um it sound it looks like officially we need Early College in the name where every option has that right because we need to be clear um can y'all talk a little bit did you have any conversation that that would help frame the community's thinking about the health versus medical that seem to be different things in these and how we differentiate from City of medicine Academy and that the importance
of not confusing um families as they're choosing from these um similar but very different options for for uh High School in the future um we uh have not had that particular conversation in this context uh but I think maybe what might be helpful is to do some defining of terms in the surveys and uh we'll make that suggestion in correction it hasn't launched yet but we have it ready to go I'm a public health person so I just love Health rather than medical or or but you know hey and I don't really love the word career in it but that's just me you know so like I think names um speak differently to different people so I'll be interested to see what the community says but thank you all any other comments or questions wonderful oh yes Miss vus
I'm so grateful that um that you know this philanthropy gave us the money for this and so I just I guess gratitude I'm going to keep going with the Gratitude and um and also the um the importance of of continuing those pipelines I think the vision for this is a pipeline um durm Tech already has a program and in the health area but I think this this definitely uh creates opportunities for four years of this kind of curriculum where before we've just only had two year two year um two years before the early college and this would be a four-year thing so in terms of the name options I know the community is going to weigh in on that um I I will just say I agree with health being the the preference um and I also I like the fact that we are calling it early college because that is also part of the vision um and I can imagine kids saying I'm well I go to the college the DPS College you know for health and health and science so I'm kind of already stating a preference but I'm I'm
open to what the community says as well I think you know um the community is going to weigh in but Health Science Early College to me that um fourth choice uh kind of rings a certain way yeah thank you thank you any other comments and the well this might be a question from Miss Cooper but the um the survey that will go out will describe what this is going to be like what the school will look like what kind of courses are being offered so that folks can weigh in with all that information and know whether the word health or the word medicine is more appropriate or there's a general statement about the purpose of the school yes um if you would prefer there to be more details we can add those as well I think along the lines of what Miss berer was talking about distinguishing it from what we already have and because if I'm someone in the community I might be like well what what's the difference between this and city of medic city of medicine or other programs that we have so something to help folks one just to understand
that this is something that's coming and to be excited about and then to give them all the information they need to weigh in greatly thank you and if you'll permit me uh uh since we have folks listening that might be willing ready to vote um we want to make sure that folks know that this new uh early college is an expansion of our health science focused um Early College model so uh we have city of medicine that is an early college it doesn't have Early College in the name and I think sometimes folks miss that as they're applying to to City of medicine and so to to the board members points about early college that was why it was intentional in the in the new name uh suggestions uh but we're not this isn't a competition against with city of medicine this is an expansion of uh students opportunities to um prepare in high school for careers in the health field that are in high demand here in Durham County
thank you again Dr PE any other thoughts from board members okay thanks we're excited about this thank you all um and we had an item um from the consent agenda that was moved to our next item on the agenda okay um and that is the contract with linear construction company or installation of crosswalk and sidewalk Edition at Lions Farm element M school good evening board members so I I'll uh I'll share what I know as of right now and then if there's any additional questions Mr Davis is here to help um so when I met with Mr Johnson for transition earlier in May uh he had shared that this specific project was a critical project that had been uh long promised to the community and um as part of the Lions Farm school project he he shared with me in terms of the funding plan for it that it was um obviously
currently it at the time it was going through the bidding in procurement process but that 24 25 Capital outlay dollars would be used to fund this project um I know there was a question um about um off-site Street improvements and responsibilities from whether city or county or what have you um I do think we need to review that um um just in terms of how off-site Street improvements are proposed um how they're approved how they're funded whether that's a county responsibility a city responsibility a board of education responsibility or some combination thereof um Dr Giovani uh attorney Malone and I have had some preliminary discussions about this uh but I think there's a lot of uh unpacking that we need to do and Discovery before we can make any recommendations to the board um that's uh my update in regards to this item if there are any additional specific questions Mr Davis is prepared to answer
them thank you yes Miss Rogers oh I'm sorry Miss thank you for this I um this has been a long time coming as I was in conversation with Dr Monk when there were requests for this crosswalk and at the time there was conversation about um the delay was not knowing where the finances were going to come from whether it was the dot the city the county and things of that nature that DPS could not afford it um so we're looking at those other sources so when I just saw that it was on the agenda and I didn't see any uh structures of where it was coming financially that's what I wanted to hear and as I hear you saying it's from the capital outlay uh for 2425 where does that sit with other needs that we have because I know this could not have been part of the comprehensive uh capitals plans from six years ago seven years ago now so I just wondering how does this fit into it at this time is it the critical knee
piece of it or is it uh I can only assume so I don't know the question is how is it now and did we exhaust conversations with the um city and Dot to help offset some of these costs cly Mr Davis good evening um so in terms of priority safe roster schools has been a priority for the board and the County Commissioners and city um the delay was from a concurrent site plan for the new construction of lions form um and with the site plan that was already submitted we didn't want to to delay the construction and opening of lion farm with any adjustments to that site plan and so uh after liance Farm was constructed and completed in 2022 uh we began the design of the crosswalk which means we had to make uh reviews to the site plan so that was the process to having approvals these are off-site Road
improvements as Mr Freeze has stated um we are working with the County finance and budget team to come up with allocation of dollars to support uh all operations and facility needs to the district um as Mr Johnson uh stated prior to his uh departure uh the capital outlay funds are used use and discretionary for priority needs throughout the district um as safety and safe rout to schools is a number one priority we will utilize this fund of tune of $590,000 for this and we will continue to work with our County uh supporters for other funds to help uh the much needed operations and Fa facilities needs for during Public Schools can you explain what you mean when you say delay by concurrent site plan yes so uh it's a review period for all site plan and whenever you make any changes to the site plan it gets put back into the Q in order for you to open
of have a period of occupancy you have to have an approved site plan and so Lions form was under an approved site plan and so at the time when we were constructing lons Farm we didn't want to make any adjustments to that site plan that would cause the school not opening and so that's where that came from that answer your question so this the sidewalk was a part of the original plan it was not it was not it was not um but after uh we started constructing and we heard from the neighborhood uh about safe routes to school we began the design process but we wouldn't we didn't want to start that process until we were currently in the school as to not delay the opening of the school okay now I know it is a critical need I'm glad that sa frosta school is involved I know we even have some grant funding for sa frosta School um I think it's a two-year grant that we have and I guess and what I hear you saying it was it be funding will come from Capital outlay 2425 capital outlay
and what I hear you say Mr Davis is that additional needs that's on our comprehensive plan will come from additional support yes his support we're already getting from our County Commissioners around that and I think um superintendent Moore has discussed uh that the county are looking at ways to provide that just needed funding and limited obligations or however they see fit so while that is taken from our annual Capital we do believe that the county will work with us on additional funding to support some other priorities on our Capital 10-year long range plan okay and have we exhausted the conversations with the city I think you said you Dr Malone and Dr Malone Mr Malone and Dr Giovani have been in conversations are we done with those conversations or is there any support we are in the incubator stages of that and trying to understand what impact fees are being assessed and how uh they benefit the school system and so as we continue to go down that road we
hopefully have more information probably in the next school year but I let Mr Malone or Dr giovan time in if there's some other information now we're definitely looking into it Sharon Lyn in my office one of the lawyers is doing some research into that she's researched this and some for some other clients and we just want to make sure we understand how the Derm fees apply with the statutory language so we're definitely taking a look at that yeah so sorry it came up in operations about impact fees and I think that's different and you might want to like give a little bit of background about those ongoing conversations because we have been assessed impact fees by the city of Durham to the tune of or $500,000 at the per student formula that you all are having conversations as part of I think I think it personally I think it's all all interconnected right because you have required off-site Street improvements or
maybe their desired off-site Street improvements and they're being done um and then you have these impact fees that are being assessed which are also for Street improvements and so the um the legislation's clear in terms of the it's for off-site work it is the responsibility of either the city or the county whoever the approving agency is that's requiring that um but we I will share that from coming into this now uh there is um there's some uniqueness here uh there's a combined City County Planning Department um you know the county is funding uh the the um capital projects um some of the work that's being proposed is being recommended recomended by staff some of it is being um recommended and required by the by again the planning agencies and so just want to do some more Discovery to kind of find out history how it's transpired over the past several projects so then we can bring forward um a recommendation
that's um that's grounded in you know prior practice knowledge about what has occurred as well as what we think uh is best and should occur moving forward I just want to add on you know with the impact VPS and I agree with Dr lefree that they are interconnected but I think that there is what triggered that and why we're kind of trying to move as fast as possible is that we have a fiduciary responsibility right to make sure that we are not just you know willy-nilly spending you know DPS money on things that should that we should not be paying and as part of that um conversations I'd had with Mr Palmer in the past where he had educated me about impact fees is kind of what triggered that in my mind and so then we reached out to Mr Malone and um his team and we have been working with them but there is some urgency because until we pay that we can't get an occupancy permit and so that can push our opening date out so we it may be you know um that we have to pay it and then kind of revisit from a back end with the
city maybe a reimbursement because we can't postpone opening Murray masser so those are kind of the conversations and I'm limited in some of what I can say because I don't want to wave attorney client privilege um and kind of the advice that we've gotten from Mr Malone but I think once we have a final answer sooner rather than later Mr Malone Dr lefree and myself will um come back with an update for the board thank you thank you uh M Rogers um thanks everybody for um those details I think I want to take us back to Lion's Farm crosswalk because that's where we what we were talking about and I want understand what are the ramifications of us not approving this and suggesting that those families at HOA go and shake down the city planning committee for this crosswalk um I know we have the bids which will expire and increase and all the
things that is correct um it is about timing um right now it's about a full month lead time once we get the notse to to finish the crosswalk and So currently we will not make the the opening of school for the crosswalk to be finished uh but uh the time uh principle is what we're looking at and fulfilling that and so non-approval will just delay the crosswalk until more information is forthcoming okay um the other question that I had was um did Northern get a crosswalk when we built nor we did have offsite Road improvements which was a tune of $2 million uh however ncdot required those off-site Road improvements because the location um and once we wrap up this summer uh we will receive a reimbursement of roughly a million dollars to that offside Road
Improvement and Murray massenberg is getting a crosswalk or no or so yes uh the city is funding that uh crosswalk and turn signal um but Murray mburg also has uh impact fees that uh we're trying to gain further information before addressing uh that impact fee but that is tied as Dr Giovani said to the co that we anticipate getting on July 26 okay thank you um I think your your questions are exactly similar with what my questions are it seems like it's happening differently on different projects which is why we want to spend a little time to understand how that how that's occurring um and then bring forward a recommendation um long term I just want clarifying question what was just said the date when I was looking at the contract it said they won't be finished until December
15 on or before December 15 final completion before January 25th right so you know as we stand here today it's about a full month process so if they start this juncture say middle of July I think uh we should have budgets uh four four months is around at November December time frame so it's based on when we provide the notes to proceed and and I was just going to say because it's next year's money so it's after July 1 um and then second you know I'm sure that December timeline is to allow time for things that you might not expect that might happen so to board member Roger question about what happens if you don't approve tonight and you're looking to try to get the community to work with the city I I would say then you're a year
away yes Miss Chavez and I just want to be clear I think um DPS already committed to to doing this to creating this correct that that is correct yes okay I I think we need to follow through with our commitments so I think there's that um but this raises a larger question for me about um the which I think some of these questions are getting at how do we assess across schools um who needs a crosswalk or a sidewalk obviously some communities are more inclined to advocate for one there are obviously whole areas of the city without or the county without sidewalks so um my question and I think Miss Moore always um brings up these kind of questions which I appreciate a review process is there a review process um for so that all schools have the same
level of safety um outside particularly elementary schools well all schools but I I mean maybe they're different yeah anyway all schools and um and then would the conversations with the city and county be more um like something that could a a practice that would be applied to all of those schools or would there be a a request in Mass for um if there are multiple schools that need crosswalks and sidewalks so Mr Palmer's team um does safe rout of schools and they do annual review of all of our walkable multimodal transportation to and from schools we also are including that in our facility conditions assessment um whether it's the exterior the interior and the site and so we will have a comprehensive list of all the needs in the district uh in December and that will all allow us to parcel out various projects pertaining to Safe routs of schools hbac Electrical uh the whole
gamut of what we really need to be a healthy thriving District thank you for that I'm glad to hear that I was thinking about our facilities assessment so I'm glad to know it includes um exterior areas to the schools I guess then my question is um like why did this get off left off the list or like why did the community have to advocate for it we know that it's a need to have safe uh routes to school um as we review the site plan um there are things called committed elements um and unfortunately if the city makes it a requirement um and Mr Malone will help me with the statute they are actually liable to reimburse the school system to pay for that um and in this juncture of lions form it was not made a requirement um to have a crosswalk added to uh Lions form uh but the need was still present and the district decided to move forward uh with that need if I could just expand on that for
the future the advocacy that board member Rogers was talking about would have been better served happening during the design process when it wasn't there for the community to you know Advocate to the city or the county around the need that could then be included on the front end with an agreement around the city or the county taking on the cost per the legislation versus we have no choice but to figure out how to fund it ourselves when it comes after the fact right so this is you know the earlier that sort of thing happens um because if the community is communicating directly with the city of the county that can impact whether or not the city or the county says yes do this and then they pay for it and that's what happened with Murray
massenberg thus we have a crosswalk that is funded by the city um but Community has to advocate for it it's not um like per it's it's about who it's about it's who requires it it's who says we need this we say we need it we pay for it they say they we need it they pay for it it's it's that's if they and so that they don't have the data the advocacy or the voice to say yes do it and of of course we're talking about new facilities right yeah and so you have the issue at all the old facilities where you know the lens at that time didn't necessarily support uh those offsite um those off-site amenities right and I'm thinking my question was thinking back to what board member Chavez was asking about which is like equity and like who can who will Advocate and who wants to Advocate and how to make sure that all kids have safe
routes to schools but that's clarifies thank you um miss bayadas you had a comment or question I I think I I hear the technicality of the city maybe saying this is not necessary and DPS saying this is necessary um but I I want to ask our um attorney Mr Malone I'm very interested in reimbursement and I and I think as a district we we need to pursue that if we pay for this this is money that we need to get back from the city because this is in their purview I think making the case for why it's necessary we lost we lost more than one student has been hit um by vehicle and actually we we we we have um we have all all all the uh feedback and the emails and the engagement from families about having this for safety so I I think in terms of legal terms when it comes to trying to get the money and saying you know this is this is something that did not fall in our purview this Falls
in your purview to the city right um what are some of our options so the the statute that um Todd was mentioning earlier it's it's set up such that if the Department of Transportation requires the road approve the road Improvement on the state road or if the city or municipality requires the Improvement on a local road then they are responsible for the cost of it so the idea is is that if they want to see the Improvement then they have to pay for it there is not really a mechanism for us to just make the argument that we believe it's important for the community and we want you to pay for it so that's really not an option under the current statutory framework it's only when they are imposing on you kind of an off-site improvement that that if it's a state road and do require it do pays for it
like you're going to get a reimbursement for Northern um and and most municipalities Now understand that if they impose these requirements they have to pay for them what we're seeing is that fewer requirements are being imposed Now by municipalities because they have to pay for them they were happy to impose them when they could just impose them and have you pay for them does that help that helps um I I know that the city has intervened with do I've had issues with some DPS families who were on one of the dot properties and conversations where the city was navigating those conversations so I guess it's important uh to um superintendent Moore's comments about advocacy it would have been better earlier on however I I still do think that if they deem this a a necessary thing that they somehow missed because things can be missed that we might be able to get our money and so the advocacy I think it's not a far-gone conclusion like I think that there's still an opportunity by which Maybe that conversation about um the assessment
assessing the situation and maybe do siding with families so I think the advocacy needs to be on but um that was just my comment to to that point that I think there's still time or there's still maybe um I think theot can be budged and I have seen that happen personally they actually let go of one of their properties on uh Club Boulevard that was a site that they um use the city of durum to evacuate all including DPS families were evacuated from that and do could be persuaded um So yeah thank you a clarify Mr Davis this is the city though right do was Northern correct but Scott King Road is Scott King is the city but I think their argument resonates as well okay I think you've been waiting Miss um said do you want to go next or miss berer it looks like he interested in oh I was just gonna make a motion but so she I need to I think most of my comments have already been made I just uh so now I'm thinking about the new elementary schools that are in our bond
that we're doing renovations on and do they need offsites or not and who's paying for that and how do we get the offside improvements into the plan versus after the plan is what I'm also thinking about and at some point whenever Jordan High School comes because it is horrible trying to cross the street over there that that needs to be in if that you know if pending we build it at that same site right how do we include offs sites in the beginning crosswalks and all that versus at the end so that's what my brain is going to and then two year I was wondering to about new facility versus facilities that are currently existing I've had several teachers come to me from Southern and talks about how those windy roads are horrible and students are walking down there all the time so I would hope to when we're thinking about safer routes it's not just around age but it's also understanding how many kids in a community are walking what the roads look like around that community and then making those assessments across Elementary Middle and High versus just looking at one approaching it from one group or the other so those are my I I
will say um L Farm is is a a Aster because I call that a covid year um communication was not its best and if you remember Li Farm was designed in 2016 and was taken off the shelf and so it was already pretty much ready to go um and at that time the community nearby wasn't as active as it is now once we we built it and so I can as we move forward through new designs that will take that collaboration and those much needed uh facility needs out outside and inside the building to heart so yeah and I think to sorry inter superintendent Morris point if there's advocacy needed please let the Board of Education know we can figure out what the right steps are to do the advocacy on that piece I think that's vital yeah um I just wanted to also um refer the commitments we make to people are important to me also and I seem to remember this being a long-standing commitment that was wrapped up in some other things we don't necessarily need to go through all of them but this is
important for us to follow through with yes uh a part of the site plan was some other uh traffic impacts that were tied to a developer that uh satisfied those committed elements um thus the changes on the site plan occurred after the project was was finished um but I think yes it was a part of some committed elements on their original site plan U that we didn't want to disturb until after those things were taken off by the city's approval and completed by the developer um and thus the new site plan um has those committed elements and the new crosswork on it thank you yes Miss Rogers I just want to make sure everybody understands that I just wanted all of us to understand why it was important to move forward not that I was suggesting that we shouldn't thank you I entertain motion I'm move that we approve the
