To adopt a Resolution Authorizing the City Manager to Execute a 10-Year Lease with Liberty Arts, Inc. for the Liberty Arts Pavilion Located at 505 Rigsbee Avenue; and
To authorize the City Manager to execute subsequent documents permitted by or required by the Lease Agreement, including any amendments, extensions, renewals, or related documents.

9. Durham Rail Trail Construction Manager at Risk (CMAR) Contract with Balfour Beatty Construction / Holt Brothers Construction, a Joint Venture
To adopt the resolution finding that the use of construction manager at risk (CMAR) services is in the best interest of the Durham Rail Trail project as determined by the City pursuant to N.C.G.S. 143-128.1(e);
To adopt a resolution approving the prequalification process for the Durham Rail Trail project consistent with the requirements of N.C.G.S. 143-128.1(c);
To authorize the City Manager to negotiate and execute a CMAR contract with Balfour Beatty Construction / Holt Brothers Construction, a Joint Venture for preconstruction services for the Durham Rail Trail project for an amount not to exceed $300,749;
To establish a contingency fund in the amount of $30,074; and
To authorize the City Manager to negotiate and execute modifications to the CMAR contract for preconstruction services provided that the total amount, together with all modifications and existing contingency funds, does not exceed $330,823.

17. Service Contract with Palmetto Underground Solutions LLC for the 2026 Lead Service Line Inventory Field Verifications Project
To authorize the City Manager to execute the 2026 Lead Service Line Inventory Field Verification Project Contract with Palmetto Underground Solutions LLC in an amount not to exceed $900,000;
To establish a contingency fund in the amount of $180,000; and
To authorize the City Manager to negotiate and execute modifications to the 2026 Lead Service Line Inventory Field Verification Project Contract, provided that the total contract amount including existing contingency funds does not exceed $1,080,000.

To authorize the City Manager to execute a contract with PC Construction Company for construction of the Williams Water Treatment Plant Basin Improvements project in the amount of $37,078,000;
To establish a contingency fund for the contract in the amount of $3,700,000; and
To authorize the City Manager to negotiate and execute modifications to the contract provided the cost of all change orders together with the original contract amount does not exceed $40,778,000.
