7. PUBLIC WORKS OPERATIONS CENTER RENOVATION CONSTRUCTION MANAGER AT RISK AGREEMENT WITH C. T. WILSON CONSTRUCTION CO., INC

To adopt the resolution finding that the use of construction manager at risk (CMAR) services is in the best interest of the Public Works Operations Center Renovation project as determined by the City pursuant to N.C.G.S. 143-128.1(e);

To adopt the resolution approving the prequalification process for the Public Works Operations Center Renovation project consistent with the requirements of N.C.G.S. 143-128.1(c); and

To authorize the City Manager to negotiate and execute a CMAR agreement with C. T. Wilson Construction Co., Inc. for preconstruction services for the Public Works Operations Center Renovation project for an amount not to exceed $220,000.

To authorize the City Manager to execute an amendment to the existing contract for Water Quality Web Portal Repair and Maintenance for the Stormwater Quality Program, with Geotech Computer Systems, Inc. in the amount of $25,000 for a revised total contract amount of $101,000.

11. SUPPLEMENTAL AGREEMENT #3 TO MASTER AGREEMENT #18906 WITH EXULT ENGINEERING, PC FOR MULTIMODAL SAFETY IMPROVEMENTS TO GUESS ROAD

To authorize the City Manager to execute Supplemental Agreement #3 with Exult Engineering, PC in accordance with the terms and conditions of the Master Agreement titled, City of Durham, North Carolina Master Agreement for Transportation On-Call Services between the City and Exult Engineering, PC dated April 1, 2022, in the amount of $232,100;

To establish a project contingency fund in the amount of $162,400; and

To authorize the City Manager to negotiate and execute modifications to Supplemental Agreement #3 with Exult Engineering, PC, provided that the total contract amount, including existing contingency funds, does not exceed $394,500.

12. SUPPLEMENTAL AGREEMENT #5 TO MASTER AGREEMENT #18925 WITH WSP USA INC. FOR DESIGN OF MULTIMODAL SAFETY IMPROVEMENTS ON CITY-MAINTAINED ROADS

To authorize the City Manager to execute Supplemental Agreement #5 with WSP USA Inc. in accordance with the terms and conditions of the Master Agreement titled, City of Durham, North Carolina Master Agreement for Transportation On-Call Services between the City and WSP USA Inc. dated April 1, 2022, in the amount of $299,264.64.

13. SUPPLEMENTAL AGREEMENT #3 TO MASTER AGREEMENT #18919 WITH STANTEC CONSULTING SERVICES, INC. FOR DESIGN OF TWO-WAY CONVERSION OF ROXBORO STREET AND MANGUM STREET

To authorize the City Manager to execute Supplemental Agreement #3 with Stantec Consulting Services, Inc. in accordance with the terms and conditions of the Master Agreement titled, City of Durham, North Carolina Master Agreement for Transportation On-Call Services between the City and Stantec Consulting Services, Inc. dated April 1, 2022, in the amount of $498,500.

14. SECOND AMENDMENT TO THE CONTRACT WITH RATP DEV USA, INC. FOR THE MANAGEMENT, OPERATION, AND MAINTENANCE OF THE GODURHAM FIXED ROUTE TRANSIT SYSTEM

To authorize the City Manager to execute the second amendment to Contract with RATP Dev USA, Inc. for the management, operation, and maintenance of the GoDurham fixed-route transit system in an amount not to exceed $3,335,000, for a revised total contract amount of $264,879,849.51.

15. GODURHAM FY2024 ANNUAL REPORT

To receive a report on the GoDurham Transit System's FY2024 performance.

16. GOVERNING AGREEMENTS FOR THE 2025-2028 CITY OF DURHAM TRANSPORTATION ON-CALL PROFESSIONAL SERVICES – ENGINEERING SERVICES AND DATA COLLECTION

To authorize the City Manager to execute the Governing Agreements for 2025-2028 Transportation Professional Engineering Services and Data Collection with the 31 selected organizations listed in Exhibit A - On-Call Vendor List; and

To authorize the City Manager to negotiate and execute Supplemental Agreements for services up to $250,000 pursuant to the terms of the Governing Agreement.

17. CONSTRUCTION CONTRACT AWARD TO CAROLINA CIVILWORKS INC FOR THE 2025 WATER AND SEWER POINT REPAIR

To authorize the City Manager to execute a contract with Carolina Civilworks Inc for the 2025 Water and Sewer Repair Project in the amount of $11,313,560;

To establish a contingency fund for the contract in the amount of $1,131,355; and

To authorize the City Manager to negotiate change orders for the contract provided that the total contract cost does not exceed $12,444,915.

18. CONSTRUCTION CONTRACT TO TERAFLEX GROUP, LLC FOR THE FY25 UNSCHEDULED PIPELINE AND PLANT REPAIRS PROJECT

To authorize the City Manager to execute the FY25 Unscheduled Pipeline and Plant Repairs contract with Teraflex Group, LLC in an amount not to exceed $2,386,425.00;

To establish a contingency fund for the contract in the amount not to exceed $238,642.00; and

To authorize the City Manager to negotiate change orders for the contract provided that the total contract cost does not exceed $2,625,067.00.

19. CONSTRUCTION AWARD TO TERAFLEX GROUP LLC FOR THE ALBANY, PEACHTREE, GATTIS WATERLINE REPLACEMENT PROJECT

To authorize the City Manager to execute the Albany, Peachtree, Gattis Waterline Replacement Project with Teraflex Group LLC in an amount not to exceed $1,668,069;

To establish a contingency fund in the amount of $166,806; and

To authorize the City Manager to negotiate and execute modifications to the Albany, Peachtree, Gattis Waterline Replacement Project, provided that the total contract amount including existing contingency funds does not exceed $1,834,875.

20. CONSTRUCTION CONTRACT TO CAROLINA CIVILWORKS INC FOR THE FY25 UNSCHEDULED PIPELINE AND PLANT REPAIRS PROJECT

To authorize the City Manager to execute the FY25 Unscheduled Pipeline and Plant Repair contract with Carolina Civilworks Inc, in an amount not to exceed $2,318,667.50;

To establish a contingency fund for the contract in the amount not to exceed $231,866.50; and

To authorize the City Manager to negotiate change orders for the contract provided that the total contract cost does not exceed $2,550,534.

In an effort to preserve the intent of open government and maintain a positive environment for citizen input and Council decision-making, the following Rules of Decorum have been established. Compliance with these rules is expected and appreciated. 1. All citizens may participate in the public process. 2. Speakers will conduct themselves in a civil and respectful manner at all times. - Name-calling, shouting, yelling, screaming, profanity and/or obscenity is forbidden. - Refrain from the use of obscene language, “fighting words” likely to incite violence from the individual(s) to whom the words are addressed, or other language which is disruptive to the orderly and fair progress of discussion at the meeting. - Speakers will refrain from making comments of a personal nature regarding others. 3. The Mayor serves as the presiding officer of the Council; the Mayor Pro Tem serves in the Mayor's absence. - Speakers will state their name and address. - Speakers will address the presiding officer. - Questions to Council members or City staff will be facilitated by the presiding officer. - Speakers will refrain from the use of individual City staff names. It is appropriate to refer to staff by title and/or department. 4. Citizens must sign up to address Council using procedures outlined for Council meetings and Council Work Sessions. 5. Citizens may speak only to the matter for which they signed up and, in the case of public hearings, those matters which have been advertised and placed on the Council meeting agenda. 6. Citizens are encouraged to prepare remarks in advance for submission to the public record. Prepared remarks should be submitted to the Clerk prior to the start of the meeting or at the end of their comments. Additional material may be submitted to supplement remarks. 7. In an effort to accommodate all who wish to address Council at a Council meeting while preserving a reasonable and efficient meeting schedule, each speaker will have a specified amount of time to deliver comments. Comments will be timed by the City Clerk or designee; signals will be provided at the one-minute and 30-second measures. Speakers are expected to cease comments immediately upon end-time. - Council Work Sessions: Citizens who sign up in advance will be allowed to speak for up to 3 minutes. - City Council Meetings: Citizens who sign up in advance will be allowed to speak for up to 3 minutes. 8. Audience members shall: - Refrain from private conversations during the meeting - Come and go from the meeting space in the least disruptive manner possible. 9. No campaign placards, banners, or signs will be permitted in the City Council Chambers or Committee Room. Other signage is permitted except signs which violate the Rules of Decorum or that block the view of other attendees. 10. Exhibits, displays, and visual aids used in connection with presentations to the City Council are permitted. Video and/or PowerPoint presentations requested by citizens as visual aids must be submitted in advance via the Request to Speak form. Flash drives or any other hardware will not be inserted or connected to the City’s equipment or network.
