7. FY24 Capital Improvement Plan (CIP) Project Close Out and Related Budget Ordinance Amendments

To adopt an Ordinance amending the General Capital Improvements Project Ordinance, the same being Ordinance #16163, for the purpose of closing various projects deemed complete and in the amount of $54,256,966, to reallocate project savings to other projects in the amount of $2,746,029, to increase funding by $1,448,630 for Project Management Services, and to transfer $1,548,000 to the Stormwater Capital Improvements Project Ordinance and $2,976,750 to the Solid Waste Capital Improvements Project Ordinance for Fleet purchases;

To adopt an Ordinance amending the Water & Wastewater Capital Improvements Project Ordinance, the same being Ordinance #16164, for the purpose of closing various projects deemed complete and in the amount of $119,522,461;

To adopt an Ordinance amending the Stormwater Capital Improvements Project Ordinance, the same being Ordinance #16165, for the purpose of closing various projects deemed complete and in the amount of $2,442,721, to increase the FY24 Stormwater Fleet project by $1,548,000 and to increase funding by $250,000 for a grant from the Golden LEAF Foundation;

To adopt an Ordinance amending the Solid Waste Capital Improvements Project Ordinance, the same being Ordinance #16166, for the purpose of increasing the FY24 Solid Waste Fleet project by $2,976,750 and to increase funding by $241,220 for project management services;

To adopt an Ordinance amending the Parking Capital Improvements Project Ordinance, the same being Ordinance #16167, for the purpose of closing various projects deemed complete and in the amount of $1,651,901 and to reallocate project savings in the amount of $533,143 to the Parking Operating Fund;

8. Contract with JPMorgan Chase Bank, N.A. for Banking Services

To authorize the City Manager and/or her designee to negotiate and execute a contract with JPMorgan Chase Bank, N.A. for banking services not to exceed $300,000 for a period of two years with options to extend for additional two-year periods.

To authorize the City Manager to execute a contract with White Herring Tractor & Truck LLC of Greensboro, NC for the purchase of three (3) service body trucks for a total amount of $448,872.18.

10. Service Agreement for Project Management Consulting Services with Turner & Townsend Heery, LLC

To authorize the City Manager to execute a service agreement for Project Management Consulting Services with Turner & Townsend Heery, LLC for an amount not to exceed $1,700,000.

11. Amendment to HUD Grant Project Ordinances

To adopt an Ordinance amending the Grant Project Ordinance for 2020-21 HUD Cooperative Agreement Fair Housing Grant, the same being Ordinance #15721, to reflect the de-obligation of $1,304 in training funds, reducing the total training funds to $16,296;

To adopt an Ordinance amending the Grant Project Ordinance for FY21-22 HUD Cooperative Agreement Fair Housing Grant, the same being Ordinance #15891, to reflect the de-obligation of $15,002 in training funds, reducing the total training funds to $6,998; and

To adopt an Ordinance amending the Grant Project Ordinance for 2022-23 HUD Cooperative Agreement Fair Housing Grant, the same being Ordinance #16020, to reflect the de-obligation of $3,607.01 in training funds, reducing the total training funds to $15092.99.

13. Contract with Pace Analytical Services, LLC for Laboratory Services for the Public Works Stormwater Quality Program

To authorize the City Manager to execute a contract with Pace Analytical Services, LLC for $30,000 for environmental laboratory services; and

To authorize the City Manager to renew the contract an additional two (2) years for a total contract period of up to four (4) years and not to exceed a total contract amount of $80,000.

Transportation Department

14. First Amendment to the Contract with RATP Dev USA, Inc. for the Management, Operation, and Maintenance of the GoDurham Fixed Route Transit System(CT-19910)

To authorize the City Manager to execute the first amendment to the contract with RATP Dev USA, Inc. for the management, operation, and maintenance of the GoDurham fixed-route transit system.

Water Management Department

15. Professional Engineering Services Contract with Freese & Nichols, Inc. for the Northeast Creek Sewer Basin Hydraulic Model

To authorize the City Manager to execute a contract for the Northeast Creek Sewer Basin Hydraulic Model project with Freese & Nichols, Inc. in the amount not to exceed $1,610,438;

To establish a contingency fund in the amount not to exceed $153,562; and

To authorize the City Manager to negotiate and execute modifications to the contract for the Northeast Creek Sewer Basin Hydraulic Model project, provided that the total contract amount including contingency funds does not exceed $1,764,000.

In an effort to preserve the intent of open government and maintain a positive environment for citizen input and Council decision-making, the following Rules of Decorum have been established. Compliance with these rules is expected and appreciated. 1. All citizens may participate in the public process. 2. Speakers will conduct themselves in a civil and respectful manner at all times. - Name-calling, shouting, yelling, screaming, profanity and/or obscenity is forbidden. - Refrain from the use of obscene language, “fighting words” likely to incite violence from the individual(s) to whom the words are addressed, or other language which is disruptive to the orderly and fair progress of discussion at the meeting. - Speakers will refrain from making comments of a personal nature regarding others. 3. The Mayor serves as the presiding officer of the Council; the Mayor Pro Tem serves in the Mayor's absence. - Speakers will state their name and address. - Speakers will address the presiding officer. - Questions to Council members or City staff will be facilitated by the presiding officer. - Speakers will refrain from the use of individual City staff names. It is appropriate to refer to staff by title and/or department. 4. Citizens must sign up to address Council using procedures outlined for Council meetings and Council Work Sessions. 5. Citizens may speak only to the matter for which they signed up and, in the case of public hearings, those matters which have been advertised and placed on the Council meeting agenda. 6. Citizens are encouraged to prepare remarks in advance for submission to the public record. Prepared remarks should be submitted to the Clerk prior to the start of the meeting or at the end of their comments. Additional material may be submitted to supplement remarks. 7. In an effort to accommodate all who wish to address Council at a Council meeting while preserving a reasonable and efficient meeting schedule, each speaker will have a specified amount of time to deliver comments. Comments will be timed by the City Clerk or designee; signals will be provided at the one-minute and 30-second measures. Speakers are expected to cease comments immediately upon end-time. - Council Work Sessions: Citizens who sign up in advance will be allowed to speak for up to 3 minutes. - City Council Meetings: Citizens who sign up in advance will be allowed to speak for up to 3 minutes. 8. Audience members shall: - Refrain from private conversations during the meeting - Come and go from the meeting space in the least disruptive manner possible. 9. No campaign placards, banners, or signs will be permitted in the City Council Chambers or Committee Room. Other signage is permitted except signs which violate the Rules of Decorum or that block the view of other attendees. 10. Exhibits, displays, and visual aids used in connection with presentations to the City Council are permitted. Video and/or PowerPoint presentations requested by citizens as visual aids must be submitted in advance via the Request to Speak form. Flash drives or any other hardware will not be inserted or connected to the City’s equipment or network.
