18. CONTRACT AMENDMENT NO. 2 WITH MOSS+ROSS LLC FOR COMMUNICATIONS CONSULTING SERVICES
To authorize the City Manager to amend contract #17648 with moss+ross LLC for communication consulting services, extending the term by 18 months and increasing the budget by $150,000, funded with Dedicated Housing Funds, bringing the total contract value from $300,000 to $450,000.
19. CONTRACT AMENDMENT WITH CORPORATE F.A.C.T.S FOR TECHNICAL ASSISTANCE ON AN AFFORDABLE HOUSING PROJECT
To authorize the City Manager to execute a contract amendment with Corporate F.A.C.T.S., Inc. to increase the contract total to an amount not to exceed $170,016; and to extend the contract term through June 30, 2025 to provide technical assistance on an affordable housing project.
To authorize the City Manager to execute any and all documents and instruments, necessary, reasonable and appropriate to carry out the purpose and intent of this contract amendment; and
To authorize the City Manager to make necessary and sundry changes to the contract amendment so long as the changes do not increase the financial obligations of the City, and the changes taken as a whole, are not less favorable to the City.
20. FIRST AMENDMENT TO THE CONTRACT WITH VOLUNTEERS OF AMERICA OF THE CAROLINAS, INC. FOR THE PROVISION OF COORDINATED ENTRY WITH DIVERSION SERVICES
To authorize the City Manager to execute the First Amendment to the Contract with Volunteers of America Carolinas, Inc. to provide coordinated entry and diversion services to households experiencing homelessness to extend the contract until June, 30, 2025 and increase the contract by $477,500 for a total contract value not to exceed $1,432,500.
21. CONTRACT WITH NORTH CAROLINA COALITION TO END HOMELESSNESS (NCCEH) TO PROVIDE HOMELESS MANAGEMENT INFORMATION SYSTEM LEAD AGENCY SERVICES
To authorize the City Manager to execute a contract with the North Carolina Coalition to End Homelessness, Inc. to provide services as the HMIS Lead Agency for one year in the amount of $78,498.00 using Dedicated Housing Funds.
22. AMERICAN RESCUE PLAN ACT (ARPA) REVISED COMMITMENT LETTER TO BRADLEY HOUSING DEVELOPERS LLC FOR THE SANDY RIDGE STATION PROJECT
To authorize the City Manager to issue to Bradley Housing Developers LLC, or its designated affiliate approved by the City, a revised commitment of acquisition and construction-to-permanent financing for the Sandy Ridge Station project in an amount up to $6,845,000;
To authorize the City Manager to execute any and all documents and instruments necessary, reasonable, and appropriate to carry out the purpose and intent of this commitment; and
To authorize the City Manager to make necessary and sundry changes to the commitment of financing and associated documents, provided that the changes do not increase the financial obligations of the City and, taken as a whole, are not less favorable to the City.
23. RESOLUTION PROVIDING APPROVAL OF A MULTIFAMILY HOUSING FACILITY TO BE A PORTION OF THE LOFTS AT SOUTHSIDE AND THE FINANCING THEREOF WITH MULTIFAMILY HOUSING REVENUE BONDS
To adopt a resolution providing approval of a multifamily housing facility to be a portion of the Lofts at Southside and the financing thereof with multifamily housing revenue bonds in an aggregate amount not to exceed $7,000,000.

24. FIRST AMENDMENT TO THE GEOTECHNICAL ENGINEERING SERVICES CONTRACT WITH ECS SOUTHEAST, LLC FOR THE DURHAM STATION TRANSIT CENTER IMPROVEMENTS PROJECT
To authorize the City Manager to execute the First Amendment to Contract for Geotechnical Engineering Services for the Durham Station Transit Center Improvements Project between the City of Durham and ECS Southeast, LLC in the amount of $67,000 for a revised, total contract amount not to exceed $114,000;
To establish a contingency fund in the amount of $20,000; and
To authorize the City Manager to negotiate and execute modifications to the Contract for Geotechnical Engineering Services for the Durham Station Transit Center Improvements Project between the City of Durham and ECS Southeast, LLC, provided that the total contract amount including existing contingency funds does not exceed $134,000.
25. UNITED STATES DEPARTMENT OF AGRICULTURE (USDA), FOREST SERVICE INFLATION REDUCTION ACT URBAN AND COMMUNITY FORESTRY GRANT
To authorize the City Manager to execute an agreement with the United States Department of Agriculture (USDA) for the Federal Financial Assistance Award of Domestic Grant 24-DG-11083150-542 Between the City of Durham and the USDA, Forest Service Southern Region, R8 - Inflation Reduction Act Urban and Community Forestry Expansion program in the amount of $5,273,538.50; and
To adopt the City of Durham and United States Department of Agriculture (USDA) Inflation Reduction Act Urban and Community Forestry Expansion Grant Project Ordinance in the amount of $5,273,538.50.
26. UNITED STATES DEPARTMENT OF AGRICULTURE (USDA), FOREST SERVICE INFLATION REDUCTION ACT URBAN AND COMMUNITY FORESTRY GRANT SUBRECIPIENT GRANT AGREEMENT WITH KEEP DURHAM BEAUTIFUL, INC.
To authorize the City Manager to execute a United States Department of Agriculture (USDA), Forest Service Inflation Reduction Act Urban and Community Forestry Program subrecipient grant agreement with Keep Durham Beautiful, Inc. in an amount not to exceed $559,125.

29. OLD CHAPEL HILL ROAD PARK FIELD REPLACEMENT PROJECT PURCHASE CONTRACT WITH FIELDTURF USA, INC.
To authorize the City Manager to execute a purchase contract for the Old Chapel Hill Road Park Field Replacement project with FieldTurf USA, Inc., in an amount not to exceed $453,995;
To establish a contingency fund in the amount of $50,000; and
To authorize the City Manager to negotiate and execute modifications to the purchase contract for the Old Chapel Hill Road Park Field Replacement project, provided that the total contract amount including existing contingency funds does not exceed $503,995.

30. AMENDMENTS TO CITY OF DURHAM CLASSIFICATION AND COMPENSATION PLANS
To authorize the City Manager to amend the City's General Step, Open Range, Police and Fire Compensation Plans, applying market adjustments to the salary structures effective July 1, 2024; and
To authorize the City Manager to amend the City's Classification Plan, adding new classifications, effective July 1, 2024.

33. CONTRACT AMENDMENT NO. #4 WITH DOWNTOWN DURHAM INC. FOR FY2024-25 CITY SERVICES AND PROGRAMS FOR THE DOWNTOWN DURHAM MUNICIPAL SERVICE DISTRICT
To authorize the City Manager to execute a contract amendment with Downtown Durham, Inc. (DDI) to provide services and programs within the Downtown Durham Municipal Service District in the amount of $1,663,700 for total contract amount not to exceed $6,092,200 for FY2024-25 subject to City Council budget authorization.

To authorize the City Manager to execute Contract Amendment No. 3 to the East Durham Water and Sewer Rehabilitation and Belt Street Regional Stormwater Improvements Project with Hazen and Sawyer, P.C. in the amount of $4,046,460.41 for a revised, total contract amount not to exceed $8,393,298.85;
To amend the existing contingency fund of $434,683.85 by an increase of $115,347.54 for a revised, total contingency fund of $550,031.39; and

Adjournment: //cityordinances.durhamnc.gov/OnBaseAgendaOnline/Meetings/ViewMeeting?id=651&doctype=1#mediaAndItemView "Read more details about this section") Rules of Decorum for Citizen Participation In support of and respect for an open, fair and informed decision-making process, the City Council and the Administration recognize that: - civil, respectful and courteous discourse and behavior are conducive to the democratic and harmonious airing of concerns and decision making; and - un-civil discourse and/or discourteous and inappropriate behavior have a negative impact on the character and productivity of the decision-making process. In an effort to preserve the intent of open government and maintain a positive environment for citizen input and Council decision-making, the following Rules of Decorum have been established. Compliance with these rules is expected and appreciated. 1. All citizens may participate in the public process. 2. Speakers will conduct themselves in a civil and respectful manner at all times. - Name-calling, shouting, yelling, screaming, profanity and/or obscenity is forbidden. - Refrain from the use of obscene language, “fighting words” likely to incite violence from the individual(s) to whom the words are addressed, or other language which is disruptive to the orderly and fair progress of discussion at the meeting. - Speakers will refrain from making comments of a personal nature regarding others. 3. The Mayor serves as the presiding officer of the Council; the Mayor Pro Tem serves in the Mayor's absence. - Speakers will state their name and address. - Speakers will address the presiding officer. - Questions to Council members or City staff will be facilitated by the presiding officer. - Speakers will refrain from the use of individual City staff names. It is appropriate to refer to staff by title and/or department. 4. Citizens must sign up to address Council using procedures outlined for Council meetings and Council Work Sessions. 5. Citizens may speak only to the matter for which they signed up and, in the case of public hearings, those matters which have been advertised and placed on the Council meeting agenda. 6. Citizens are encouraged to prepare remarks in advance for submission to the public record. Prepared remarks should be submitted to the Clerk prior to the start of the meeting or at the end of their comments. Additional material may be submitted to supplement remarks. 7. In an effort to accommodate all who wish to address Council at a Council meeting while preserving a reasonable and efficient meeting schedule, each speaker will have a specified amount of time to deliver comments. Comments will be timed by the City Clerk or designee; signals will be provided at the one-minute and 30-second measures. Speakers are expected to cease comments immediately upon end-time. - Council Work Sessions: Citizens who sign up in advance will be allowed to speak for up to 3 minutes. - City Council Meetings: Citizens who sign up in advance will be allowed to speak for up to 3 minutes. 8. Audience members shall: - Refrain from private conversations during the meeting - Come and go from the meeting space in the least disruptive manner possible. 9. No campaign placards, banners, or signs will be permitted in the City Council Chambers or Committee Room. Other signage is permitted except signs which violate the Rules of Decorum or that block the view of other attendees. 10. Exhibits, displays, and visual aids used in connection with presentations to the City Council are permitted. Video and/or PowerPoint presentations requested by citizens as visual aids must be submitted in advance via the Request to Speak form. Flash drives or any other hardware will not be inserted or connected to the City’s equipment or network.
