4. INTERLOCAL AGREEMENT FOR THE DISTRIBUTION OF SALES TAX BETWEEN THE CITY OF DURHAM AND DURHAM COUNTY

To ratify by resolution the one-year Interlocal Agreement (ILA) with Durham County for the sharing of sales tax revenue and;

To authorize the City Manager to execute the ILA on behalf of the City.

5. AMENDMENT #1 FOR JUSTICEMATTERS, INC. CONTRACT NO. 18355 FOR THE IMMIGRATION LEGAL DEFENSE PILOT PROJECT

To authorize the City Manager to execute the First Amendment to the Grant Agreement for an Immigration Legal Defense Pilot Project with JusticeMatters, Inc. to extend the term to January 31, 2024.

6. AGREEMENT TO FUND EL CENTRO HISPANO (ECH): COVID RECOVERY INITIATIVE OPERATED BY EL CENTRO HISPANO, INC. USING CITY OF DURHAM GRANT FUNDS

To authorize the City Manager to execute a grant agreement with El Centro Hispano, Inc. to fund El Centro Hispano (ECH): COVID Recovery Initiative in an amount not to exceed $466,424.93 and;

To adopt the revised American Rescue Plan Act (ARPA) of 2021 Grant Project Ordinance Superseeding Grant Project Ordinance #16195.

7. AMERICAN RESCUE PLAN ACT PROJECT (ARPA) - ROAD TO WEALTH BUILDINGPROJECT

To authorize the City Manager to execute an ARPA subrecipient grant agreement with Durham Business and Professional Chain, Incorporated (The Chain) in an amount not to exceed $1,000,000 for technical support to small businesses, co-working spaces, and vocational skills training through Vocational Skills Institute development.

8. AMENDMENT TO CONTRACT #18394 BETWEEN THE CITY OF DURHAMAND DURHAM COUNTY FOR THE PROVISION OF THE HOUSING OPPORTUNITIES FOR PERSONS WITH AIDS (HOPWA) HOUSING ASSISTANCE AND RELATED SUPPORTIVE SERVICES

To ratify the services provided by Durham County by and through the Department of Social Services as a project sponsor subrecipient beginning July 1, 2023 to present;and

To authorize the City Manager to execute the first amendment to contract #18394 with Durham County (1) to fully administer the housing support services under the Housing Opportunities for Persons with AIDS (HOPWA) program, (2)to incorporate Granville County into the current eligible metropolitan statistical area for HOPWA service delivery (3)to extend the contract from to June 30, 2024 (4) and to increase contract total, using HOPWA funding, by $445,545.28 in an amount not to exceed $1,152,020.50.

9. FY24 DEBT SERVICE FUND AND WATER AND SEWER FUNDS BUDGET ORDINANCE AMENDMENTS

To adopt an ordinance amending the City of Durham Budget Ordinance as amended, Fiscal Year 2023-2024, the same being Ordinance #16165.

To authorize the City Manager to execute a contract with White Herring Tractor & Truck LLC of Greensboro, NC for the purchase of five (5) knuckleboom trucks for a total amount of $978,121.15.

12. STRUCTURAL MAINTENANCE IMPROVEMENTS FOR PARKING FACILITIES - DESIGN AGREEMENT WITH KIMLEY-HORN AND ASSOCIATES, INC.

To authorize the City Manager to execute the Agreement to Provide Professional Service for Durham Parking Garage Repairs between the City of Durham and Kimley-Horn and Associates, Inc. in an amount not to exceed $650,100;

To establish a contingency fund in the amount of $65,000; and

To authorize the City Manager to negotiate and execute modifications to the Agreement to Provide Professional Service for Durham Parking Garage Repairs between the City of Durham and Kimley-Horn and Associates, Inc., provided the total contract amount including existing contingency funds does not exceed $715,100.

13. SERVICE CONTRACT WITH TRIANGLE STUMP REMOVAL SERVICES LLC FOR RIGHT-OF-WAY STUMP REMOVAL

To authorize the City Manager to execute the Contract for Right-of-Way Stump Removal Services with Triangle Stump Removal Services LLC in an amount not to exceed $73,724.65;

To establish a contingency fund in the amount of $56,275.35; and

To authorize the City Manager to negotiate and execute modifications to the Contract for Right-of-Way Stump Removal with Triangle Stump Removal Services LLC, provided that the total contract amount including existing contingency funds does not exceed $130,000.

14. PURCHASE CONTRACT WITH BARRS RECREATION, LLC FOR THEPLAYGROUND & SURFACE REPLACEMENT PROJECT AT WHIPPOORWILL PARK

To authorize the City Manager to execute a Purchase Contract for the Playground & Surface Replacement project at Whippoorwill Park with Barrs Recreation, LLC. in an amount not to exceed $399,986.55;

To establish a contingency fund in the amount of $15,000.00; and

To authorize the City Manager to negotiate and execute modifications to the Purchase Contract for the Playground & Surface Replacement project at Whippoorwill Park, provided that the total contract amount including existing contingency funds does not exceed $414,986.55.

15. PURCHASE CONTRACT WITH GAMETIME FOR THE PLAYGROUND & SURFACE REPLACEMENT PROJECT AT C.R. WOOD PARK

To authorize the City Manager to execute a Purchase Contract for the Playground & Surface Replacement project at C.R. Wood Park with Playcore Wisconsin, Inc, dba GameTime in an amount not to exceed $358,342.59;

To establish a contingency fund in the amount of $15,000.00; and

To authorize the City Manager to negotiate and execute modifications to the Purchase Contract for the Playground & Surface Replacement project at C.R. Wood Park, provided that the total contract amount including existing contingency funds does not exceed $373,342.59.

To authorize the City Manager to execute a renewal five-year purchase agreement with Nearmap USA Inc. for the purchase and delivery of Nearmap Vertical Imagery in the amount of $78,750.00 paid annually not to exceed $393,750.00.

To ratify the contract for City Network Core Switch Upgrade with NWN Corporation in an amount not to exceed $74,679.09 beginning on April 4, 2023, and to authorize the City Manager's execution of the contract as of April 4, 2023.

20. TRANSIT GRANT PROJECT ORDINANCE AMENDMENTS

To adopt FY2022-23 Bus and Bus Facilities Grant Project Ordinance For The Rehabilitation of Durham Station Supersedes Grant Project Ordinance #15966 and Authorization to Execute Grant Agreement; and

To adopt FY2018-19 City of Durham and State Apprentice Program Grant Supersedes Grant Project Ordinance #15308.
