8. Condemnation Action to Obtain Two Easements at 1708 Arrowhead Drive

To adopt the Resolution Authorizing Condemnation of portions of 1708 Arrowhead Drive for the Hillandale Road Sidewalk and Bicycle Facilities (SW-46D).

9. Construction Contract with Central Builders, Inc. of Mebane for Former Wheels Skating Center Upfit Project

To authorize the City Manager to execute a construction contract with Central Builders, Inc. of Mebane for the Former Wheels Skating Center Upfit Project in the amount of $2,581,500;

To establish a contingency fund for the contract in the amount of $387,225; and

To authorize the City Manager to negotiate and execute amendments to the construction contract, provided that the total project cost does not exceed $2,968,725.

10. U.S. Department of Housing and Urban Development Fair Housing Cooperative Agreement Grant Award FY 2024

To authorize the City Manager to execute the grant award documents to accept funding from the U.S. Department of Housing and Urban Development (HUD) in the amount of $94,600.00 for the continuation of the City’s fair housing program; and

To adopt the City of Durham Grant Project Ordinance.

11. U.S. Department of Housing and Urban Development Partnership Grant Award FY24

To authorize the City Manager to execute the grant award document to accept partnership grant funding from the U.S. Department of Housing and Urban Development (HUD) in the amount of $15,000.00 for conducting partnership grant activities associated with the City’s fair housing program; and

To adopt the City of Durham Grant Project Ordinance.

12. U.S. Department of Housing and Urban Development Special Enforcement Effort Funds

To authorize the City Manager to execute the grant award document to accept the special enforcement effort grant funding from the U.S. Department of Housing and Urban Development (HUD) in the amount of $6,300.00 for conducting special enforcement effort activities associated with the City’s fair housing program; and

To adopt the City of Durham Grant Project Ordinance.

13. Contract Amendment 1 to the Purchasing Contract with Bliss Products and Services, Inc. for the Playground & Surfacing Replacement Project at WD Hill Recreation Center

To authorize the City Manager to execute a contract amendment with Bliss Products and Services, Inc. to provide an additional shade structure, activity play panels, and installation services in the amount of $44,254.00 for a revised, total contract amount not to exceed $342,253.79.

Office of Economic and Workforce Development

14. Contract Amendment #1 for Durham Workforce Development Board, Workforce Innovation and Opportunity Act Youth Program Eckerd Youth Alternatives, Inc.

To authorize the City Manager to execute a contract amendment to the Workforce Innovation and Opportunity Act Contract for Youth Program Delivery with Eckerd Youth Alternatives, Inc. for the period of July 1, 2023 through September 30, 2024 in the amount not to exceed $300,000.

To authorize the City Manager to accept the 2023 Community Policing Development Micro-grant by executing the grant documents; and

To authorize the City Manager to execute Amendment No. 2 to Carpenter Fletcher Road Improvements PE Agreement (CSXT DOT No. 845869S) with CSX Transportation, Inc. for work within railroad limits in the amount of $14,850 for a revised, total contract amount not to exceed $55,466;

To establish a contingency fund in the amount of $11,093; and

To authorize the City Manager to negotiate and execute modifications to Carpenter Fletcher Road Improvements PE Agreement, provided that the total cost of the contract together with all modifications does not exceed $66,559.

18. Utility Professional Engineer Agreement (P-5706) Ellis Road

To authorize the City Manager to execute a Utility PE Agreement with NCDOT for design of the relocation of existing water lines and services under project P-5706 in the amount of $175,160.23;

To establish a contingency fund in the amount of $17,516.02; and

To authorize the City Manager to execute any change orders to the contract such that the total contract does not exceed $192,676.25.

19. Utility Extension Agreement with Shawn L. Brookshire to Serve 208 Fountain Street

To authorize the City Manager to enter into a utility extension agreement with Shawn L. Brookshire to extend water and sanitary sewer to 208 Fountain Street.

20. Supplemental Agreement #3 with the North Carolina Department of Transportation for Hillandale Road Bicycle and Pedestrian Improvements TIP #U-4726HN

To authorize the City Manager to execute Supplemental Agreement #3 with the North Carolina Department of Transportation for the Hillandale Road Bicycle and Pedestrian Improvements project (TIP #U-4726HN) for a revised amount of $6,789,831.

21. First Amendment to Contract for Durham Freeway Community Engagement Services with Aidilisms, LLC

To authorize the City Manager to execute the first amendment to the contract with Aidilisms, LLC for Durham Freeway Community Engagement Services in the amount of $50,000 for a revised contract amount of $100,000.

In an effort to preserve the intent of open government and maintain a positive environment for citizen input and Council decision-making, the following Rules of Decorum have been established. Compliance with these rules is expected and appreciated. 1. All citizens may participate in the public process. 2. Speakers will conduct themselves in a civil and respectful manner at all times. - Name-calling, shouting, yelling, screaming, profanity and/or obscenity is forbidden. - Refrain from the use of obscene language, “fighting words” likely to incite violence from the individual(s) to whom the words are addressed, or other language which is disruptive to the orderly and fair progress of discussion at the meeting. - Speakers will refrain from making comments of a personal nature regarding others. 3. The Mayor serves as the presiding officer of the Council; the Mayor Pro Tem serves in the Mayor's absence. - Speakers will state their name and address. - Speakers will address the presiding officer. - Questions to Council members or City staff will be facilitated by the presiding officer. - Speakers will refrain from the use of individual City staff names. It is appropriate to refer to staff by title and/or department. 4. Citizens must sign up to address Council using procedures outlined for Council meetings and Council Work Sessions. 5. Citizens may speak only to the matter for which they signed up and, in the case of public hearings, those matters which have been advertised and placed on the Council meeting agenda. 6. Citizens are encouraged to prepare remarks in advance for submission to the public record. Prepared remarks should be submitted to the Clerk prior to the start of the meeting or at the end of their comments. Additional material may be submitted to supplement remarks. 7. In an effort to accommodate all who wish to address Council at a Council meeting while preserving a reasonable and efficient meeting schedule, each speaker will have a specified amount of time to deliver comments. Comments will be timed by the City Clerk or designee; signals will be provided at the one-minute and 30-second measures. Speakers are expected to cease comments immediately upon end-time. - Council Work Sessions: Citizens who sign up in advance will be allowed to speak for up to 3 minutes. - City Council Meetings: Citizens who sign up in advance will be allowed to speak for up to 3 minutes. 8. Audience members shall: - Refrain from private conversations during the meeting - Come and go from the meeting space in the least disruptive manner possible. 9. No campaign placards, banners, or signs will be permitted in the City Council Chambers or Committee Room. Other signage is permitted except signs which violate the Rules of Decorum or that block the view of other attendees. 10. Exhibits, displays, and visual aids used in connection with presentations to the City Council are permitted. Video and/or PowerPoint presentations requested by citizens as visual aids must be submitted in advance via the Request to Speak form. Flash drives or any other hardware will not be inserted or connected to the City’s equipment or network.
